Approved 12/12/16 <br />OC Board of Adjustment – 10/10/16 Page 32 of 113 <br /> <br /> <br /> 1 <br />Karen Barrows: So when would you be making this next determination? 2 <br /> 3 <br />Michael Harvey: As their uses of the property are initiated. 4 <br /> 5 <br />Susan Halkiotis: So I just want to follow up on that. So let’s just pretend that we get down the road six 6 <br />months and it doesn’t appear to be used as a bona fide farm but it’s primarily used as a special event 7 <br />center for something like weddings or retreats. At that point what would happen? 8 <br /> 9 <br />Michael Harvey: As I indicated we would look to be engaging in an enforcement action if the use of the 10 <br />property wasn’t being done consistent with the exemptions afforded to it within the General Statute or that it 11 <br />was being used in violation of our local ordinances. 12 <br /> 13 <br />Susan Halkiotis: I have two more questions. One, I just made a not that there was an appeal filed after the 14 <br />Board’s decision? 15 <br /> 16 <br />Michael Harvey: Yes. 17 <br /> 18 <br />Susan Halkiotis: And you guys didn’t get the appeal. Who gets the appeal? 19 <br /> 20 <br />Michael Harvey: We weren’t notified by the Court that the appeal had been filed. So to us no appeal had 21 <br />been filed. 22 <br /> 23 <br />Andy Petesch: If I could update this issue. The Brewers’ have filed a dismissal of that appeal, that was 24 <br />something that they did to preserve their right following that but it was determined that this option was 25 <br />available, they pursued it and therefore they did not pursue the appeal. 26 <br /> 27 <br />LeAnne Brown: When was it dismissed Andy? 28 <br /> 29 <br />Andy Petesch: I filed it late last week. 30 <br /> 31 <br />Susan Halkiotis: And then my last question for the time being has to do… If we go back to the wastewater 32 <br />system design. So the design requires 82,500 square feet but only 50,000 square feet are available. I mean 33 <br />how is that reconciled? 34 <br /> 35 <br />Michael Harvey: All I can testify to is in that same packet. The Health Department issued a permit 36 <br />authorizing Ms. Brewer to move forward with her project. 37 <br /> 38 <br />LeAnne Brown: As I understand it she had to use more land… 39 <br /> 40 <br />Michael Harvey: She addressed the concern and allowed the permit to be issued. 41 <br /> 42 <br />Susan Halkiotis: Ok so ultimately the 82,500 square feet were available or made available. Is that? 43 <br /> 44 <br />Chris Brewer: Yes. 45 <br /> 46 <br />Susan Halkiotis: I’m just curious how that works.
