Did you learn recently that was incorrect? 10 <br /> 11 <br />Michael Harvey: Well, let me just state that I also labored under the same opinion that no appeal had been 12 <br />filed and we did find out that an appeal had been filed of the decision to deny the SUP. 13 <br /> 14 <br />LeAnne Brown: An appeal was in fact filed, is that correct? 15 <br /> 16 <br />Michael Harvey: Yes. 17 <br /> 18 <br />LeAnne Brown: On December 11, 2015? 19 <br /> 20 <br />Michael Harvey: Correct. The County was not notified of the appeal. 21 <br /> 22 <br />LeAnne Brown: To your knowledge has the County ever been served with that appeal? 23 <br /> 24 <br />Michael Harvey: No, ma’am. 25 <br /> 26 <br />LeAnne Brown: Did you get an application for a building permit from SPG and/or Kara Brewer around 27 <br />January of 2016? 28 <br /> 29 <br />Michael Harvey: The County received the building permit, yes ma’am. 30 <br /> 31 <br />LeAnne Brown: Alright, and what is the process when the County receives that building permit request? 32 <br /> 33 <br />Michael Harvey: All building permits are processed by the Building Inspections Division of the Planning 34 <br />Department. Different departments are assigned or requested to review the application to determine 35 <br />completeness or the need for additional permits, which includes Erosion Control, Orange County Health 36 <br />Department, Fire Marshall’s Office, and of course, Current Planning. 37 <br /> 38 <br />LeAnne Brown: And did the filing of that application cause an inquiry to you as Planning Supervisor as to 39 <br />whether further permits were needed? 40 <br /> 41 <br />Michael Harvey: Yes, it did. 42 <br /> 43 <br />LeAnne Brown: And what did you determine with regard to the January permit? 44 <br /> 45 <br />Michael Harvey: The January permit did not contain sufficient information or documentation leading me to 46 <br />change my opinion as to whether or not a SUP was required. 47 <br /> 48 <br />LeAnne Brown: And why is that? 49
