Approved 10/10/2016 <br />32 <br />VOTE: Unanimous 1 <br /> 2 <br />Samantha Cabe: Page 133, the 2 findings there; the recommended findings of staff are yes, there’s no 3 <br />conflict that I noted. Is there a motion with regard to 1 or both those findings? 4 <br /> 5 <br />MOTION made by Susan Halkiotis to adopt findings recommended by staff on page 132 . Seconded by 6 <br />Karen Barrows. 7 <br />VOTE: Unanimous 8 <br /> 9 <br />Samantha Cabe: Page 134, there are 5 findings there. I have in my notes that the fourth finding staff 10 <br />recommended changing that to a finding of yes based on evidence of the existing bond in place. And that 11 <br />modification to staff recommendation was from Mr. Harvey’s testimony. Do I have a motion with regard to 12 <br />those findings? 13 <br /> 14 <br />Barry Katz: I move to adopt them with the change that the fourth item, 5.10.8 B5 be changed to a yes. 15 <br /> 16 <br />MOTION made by Barry Katz. Seconded by Susan Halkiotis. 17 <br />VOTE: Unanimous 18 <br /> 19 <br />Samantha Cabe: The recommendations of staff set forth on page 134 is modified by testimony or adopted 20 <br />by the Board… Page 135, we will go through these separately. The first finding that we must make is that 21 <br />the use will or will not maintain or promote the public health, safety, and general welfare if located where 22 <br />proposed and developed and operated according to the plan as submitted. 23 <br /> 24 <br />Barry Katz: I have a question. Do we have to do anything about these recommendations before we finish 25 <br />page 135 or can we do it after? 26 <br /> 27 <br />Samantha Cabe: It’s my understanding that we make these findings and then before we make the ultimate 28 <br />decision to approve the permit, we make a motion to approve would be conditions. So we can go through 29 <br />these findings first. 30 <br /> 31 <br />Barry Katz: Well, I move that we accept the applicants application for section 5.3.2 A to A. That first one, as 32 <br />far as maintain/promote the public health and safety. 33 <br /> 34 <br />MOTION made by Barry Katz. Seconded by Susan Halkiotis. 35 <br />VOTE: Unanimous 36 <br /> 37 <br />Samantha Cabe: With regard to the second finding, do I have a motion? 38 <br /> 39 <br />Karen Barrows: I’ll make a motion that the use will maintain or enhance the value of the contiguous 40 <br />property. 41 <br /> 42 <br />MOTION made by Karen Barrows. Seconded by Barry Katz. 43 <br />VOTE: Unanimous 44 <br /> 45 <br />Samantha Cabe: And the third finding that we’re required to make that the location and character of the 46 <br />use, if developed according to the plan submitted, will or will not be in harmony with the area in which it is 47 <br />to be located, and the use is in compliance with the plan for the physical development of the County as 48 <br />embodied in these regulations or in the comprehensive plan or portion thereof adopted by the Board Of 49
