Approved 10/10/2016 31 regard to all the findings set forth on pages 123 through 128 of attachment 4? 1 2 MOTION made by Susan Halkiotis to adopt findings recommended by staff on pages 123 through 128. 3 Seconded by Barry Katz. 4 VOTE: Unanimous 5 6 Samantha Cabe: Thank you Mr. Bryan. Beginning on page 129 there are 3 findings of fact with the first 7 being non applicable and you may recall that the applicant did present testimony that utilities provided to 8 the site will be underground. Do I have a motion with regard to 1 or all of the findings on that page? 9 10 Karen Barrows: I’ll make a motion that we accept these items with the staff recommendations. 11 12 Samantha Cabe: I have a friendly amendment to that. I would ask that you amend your motion to include 13 modifying the finding with regard to the first finding of fact on page 129 that the finding of yes, based upon 14 the applicant testimony that utilities be installed underground. 15 16 Karen Barrows: Ok, so I will modify the motion to say that all 3 of these have a yes. 17 18 MOTION made by Karen Barrows to make a finding of yes for the findings on page 129. Seconded by 19 Susan Halkiotis. 20 VOTE: Unanimous 21 22 Samantha Cabe: Page 130, there are 2 findings of fact and I do not believe there are conflicts between 23 legal counsel and staff. Seconded by Susan 26 Halkiotis. 27 VOTE: Unanimous 28 29 Samantha Cabe: Page 131, the 2 findings of fact. The 2 findings set for th there, there’s no conflict between 30 staff and legal counsel. Do I have a motion with regard to those findings? 31 32 MOTION made by Karen Barrows to adopt findings recommended by staff on page 131. Seconded by 33 Barry Katz. 34 VOTE: Unanimous 35 36 Samantha Cabe: On page 132, there are 3 findings. The finding regarding lighting there is some difference 37 of opinion. The opinion of staff is that the ordinance reads that if lighting is required or proposed that these 38 submissions are required and it’s staffs position that the lighting is not proposed or required with this 39 project, so they have recommended a finding of non-applicable. Do I have a motion with regard to 1 or all of 40 the findings on this page? 41 42 Barry Katz: Now, the counsel recommended something different? 43 44 Samantha Cabe: I believe I had noted that counsel believed that there needed to be something submitted 45 with regard to lighting. 46 47 MOTION made by Barry Katz to adopt findings recommended by staff on page 132.
