APPROVED 6/12/17 <br />1 Harvey has in the ream all of those materials that would include the evidence that you received, the <br />2 files that you received from the County, the minutes of your meeting on the Special Use Permit <br />3 application, the file from that application, the minutes of the two meetings that you had, Mr. <br />4 Harvey's determination in your subsequent order in your hearing and I would ask that, as a <br />5 housekeeping matter, you receive that material into evidence for the purpose of the record in this <br />6 case. <br />7 <br />8 Andy Petesch: I would like to note an objection to the incorporation of the Special Use Permit <br />9 hearing record on the grounds of relevance. This is a completely different standard that's being <br />10 applied here and not all of that information, that evidence is relevant to this proceeding to the <br />11 extent that the evidence from that hearing was included in the last hearing. I don't... I have no <br />12 objection to the inclusion of the record from the previous hearing in October of 2016 on an appeal <br />13 of the decision about the same issue and same standards apply there. But I just want to register <br />14 my objection. <br />15 <br />16 Barry Katz: Is there much difference between the records from that Special Use Permit and what <br />17 was entered in by reference at our last hearing? <br />18 <br />19 LeAnn Brown: It's my recollection that the file from the Special Use Permit hearing was introduced <br />20 into evidence at the last hearing along with the minutes and was technically before you at the time, <br />21 so I believe that all of that material was introduced previously. <br />22 <br />23 Barry Katz: And is Mr. Harvey the person who would confirm that or Mr. Bryan? <br />24 <br />25 LeAnn Brown: I think the minutes of the meeting should confirm that. The County is the custodian <br />26 of all of the exhibits. <br />27 <br />28 Andy Petesch: I don't intend my objection to hold up the proceedings here but I want to make sure <br />29 it was logged for the record going forward. <br />30 <br />31 Karen Barrows: So noted, thank you. <br />32 <br />33 Barry Katz: So then... Did you want to then proceed and then when Mr. Harvey might find it he can <br />34 interject it? <br />35 <br />36 LeAnn Brown: I would ask that the Board receive into evidence all of the material that was before it <br />37 at the last meeting, which I believe includes that. <br />38 <br />39 Barry Katz: Thank you. <br />40 <br />41 Karen Barrows: So received. <br />42 <br />43 LeAnn Brown: And the procedure you followed a minute ago with Mr. Harvey was you had a <br />44 motion and a second to receive evidence. So I don't know if you're following that same procedure <br />45 or not. <br />46 <br />47 Karen Barrows: Is there a motion to receive this evidence? <br />7 <br />
