This is a hearing about whether a <br />2 determination that Mr. Harvey made... <br />3 <br />4 Karen Barrows: Right. <br />5 <br />6 LeAnn Brown: Is correct or incorrect, and anything that's happened after that is not relevant to the <br />7 issue of whether Mr. Harvey made a mistake in not following your order, and so I object to this line <br />8 of questioning completely. Ask that you not hear it. <br />9 <br />10 Karen Barrows: What do we think? <br />11 <br />12 Andy Petesch: This is relevant to the question of use and this Board has the right to take on <br />13 evidence to make a determination. If we are going to limit it to Mr. Harvey's determination and what <br />14 he analyzed, which in that case then the evidence that came in at the prior hearings and certainly <br />15 at the SUP hearing are not relevant. So I... <br />16 <br />17 Barry Katz: But Mr. Harvey didn't consider all that, what our determinations were from the previous <br />18 hearings when he made his determination. And so, why should we hear anything else? It's really <br />19 about the determination he made. <br />20 <br />21 Matt Hughes: I hear what Barry is saying but in previous hearings of this Board we've been very <br />22 liberal in terms of what we allowed into the record and I think it would be completely okay to do the <br />23 same here. I mean, we accepted these pictures, which I'm not sure exactly how that will reflect on <br />24 the appeal thus far, so you know, if we're going to do something for one party we should do it for <br />25 the other. <br />26 <br />27 Barry Katz: Fine, <br />28 <br />29 Karen Barrows: Good point. The pictures you received are for illustrative purposes because you've never been <br />33 able to see the barn, on which you've been talking about so that I don't bounce up and down if 1 <br />34 could have a standing objection to anything that is information about activities subsequent to Mr. <br />35 Harvey's determination then we'll let the record reflect that and I will be still so you can hear it. <br />36 <br />37 Karen Barrows: Ok.
