You can go ahead and answer. <br />11 <br />12 Michael Harvey: It is correct. The Brewers' elected to go through the Special Use Permitting <br />13 process and there were several meetings where we discussed what I believed would be necessary <br />14 to establish farm use prior to establishing what essentially they were arguing was agro- tourism <br />15 activity. And from my standpoint you have to have the farm before you have the tourism. They <br />16 elected then to go through the Special Use Permit process, but you are correct; it was never in <br />17 writing, and they went through the SUP process based on that conversation, <br />18 <br />19 Andy Petesch: And during that same time period, the spring and the summer, those conversations <br />20 included the possibility you just eluded to that, that they would, could, proceed as a bona fide farm <br />21 and not need any zoning approval. Is that correct? <br />22 <br />23 Michael Harvey: If there was sufficient documentation substantiating the claim per the Statute, yes <br />24 sir. <br />25 <br />26 Andy Petesch: But those discussions took place at that time... <br />27 <br />28 Michael Harvey: Yes sir. <br />29 <br />30 Andy Petesch: They were considering that's something they were interested in. <br />31 <br />32 Michael Harvey: Yes, they did. <br />33 <br />34 Andy Petesch: As an alternative. Mr. Harvey, during this process and during the <br />37 Special Use Permit process I realize Mr. Petesch was not involved but was there in fact counsel of <br />38 record for the Brewers' through the process? <br />39 <br />40 Michael Harvey: There was, <br />41 <br />42 LeAnn Brown: So they were represented by an attorney throughout that process? <br />43 <br />44 Michael Harvey: Correct. <br />45 <br />46 LeAnn Brown: I have no other questions.
