Ask that you not hear it. 8 <br /> 9 <br />Karen Barrows: What do we think? 10 <br /> 11 <br />Andy Petesch: This is relevant to the question of use and this Board has the right to take on 12 <br />evidence to make a determination. If we are going to limit it to Mr. Harvey’s determination and what 13 <br />he analyzed, which in that case then the evidence that came in at the prior hearings and certainly 14 <br />at the SUP hearing are not relevant. So I... 15 <br /> 16 <br />Barry Katz: But Mr. Harvey didn’t consider all that, what our determinations were from the previous 17 <br />hearings when he made his determination. And so, why should we hear anything else? It’s really 18 <br />about the determination he made. 19 <br /> 20 <br />Matt Hughes: I hear what Barry is saying but in previous hearings of this Board we’ve been very 21 <br />liberal in terms of what we allowed into the record and I think it would be completely okay to do the 22 <br />same here. I mean, we accepted these pictures, which I’m not sure exactly how that will reflect on 23 <br />the appeal thus far, so you know, if we’re going to do something for one party we should do it for 24 <br />the other. 25 <br /> 26 <br />Barry Katz: Fine. 27 <br /> 28 <br />Karen Barrows: Good point.
