As detailed in your staff report. 20 <br /> 21 <br />Michael Harvey: Attachment 1 of the staff abstract, page 71, of your October 10th packets. The date the 22 <br />application was filed at my office was June 17th 2016. 23 <br /> 24 <br />LeAnne Brown: and was that within 30 days of the date of your email? 25 <br /> 26 <br />Michael Harvey: Yes ma’am. 27 <br /> 28 <br />LeAnne Brown: that's my last question of Mr. Harvey, unless Andy had a cross-examination question about 29 <br />that. 30 <br /> 31 <br />Andy Petesch: Mr. Harvey was your email notifying Miss Brown of the building permit? Was that the 32 <br />question that your email was notifying applicants Council of the building permit approval? 33 <br /> 34 <br />Michael Harvey: No. I will read the email for the record as it appears on page 76. “Ms. Brown, as an update 35 <br />to the barn project on Morrow Mill Road I would like to offer the following: As you may already be aware the 36 <br />applicant has filed a building permit application proposing Construction of an agricultural structure (i.e. A 37 <br />barn) along with an affidavit indicating the structure will be used for agricultural purposes exempt from 38 <br />zoning. As a result from the submitted documentation no zoning approval of the project was required for a 39 <br />building permit. Future zoning enforcement will be dependent upon actual use of the property and whether 40 <br />it is consistent with the County's UDO or state statutory exemptions. The permit itself, as detailed on SPG 41 <br />exhibit 22, was issued on the 2nd of June 2016”. We were informing Miss Brown of the planning 42 <br />departments review of the project and this statement was derived after consultation with the County 43 <br />Attorney's Office on whether or not there was zoning Authority as defined by the statute to review a zoning 44 <br />component of the project as submitted with CB16-00020 of the building permit application. 45 <br /> 46 <br />Andy Petesch: Okay thank you very much. 47 <br /> 48 <br />88
