1
Susan Halkiotis: And you guys didn’t get the appeal. Who gets the appeal? 2
3
Michael Harvey: We weren’t notified by the Court that the appeal had been filed. So to us no appeal had 4
been filed. 5
6
Andy Petesch: If I could update this issue. The Brewers’ have filed a dismissal of that appeal, that was 7
something that they did to preserve their right following that but it was determined that this option was 8
available, they pursued it and therefore they did not pursue the appeal. 9
10
LeAnne Brown: When was it dismissed Andy? 11
12
Andy Petesch: I filed it late last week. 13
14
Susan Halkiotis: And then my last question for the time being has to do… If we go back to the wastewater 15
system design. So the design requires 82,500 square feet but only 50,000 square feet are available. I mean 16
how is that reconciled? 17
18
Michael Harvey: All I can testify to is in that same packet. The Health Department issued a permit 19
authorizing Ms. Brewer to move forward with her project. 20
21
LeAnne Brown: As I understand it she had to use more land… 22
23
Michael Harvey: She addressed the concern and allowed the permit to be issued. 24
25
Susan Halkiotis: Ok so ultimately the 82,500 square feet were available or made available. Is that? 26
27
Chris Brewer: Yes. 28
29
Susan Halkiotis: I’m just curious how that works. Why that didn’t present a problem. 30
31
Andy Petesch: Would you like to swear Ms. Brewer so that she can respond? 32
33
Barry Katz: You can respond for her, you’re her attorney. 34
35
Andy Petesch: I don’t have personal knowledge of the information. 36
37
Barry Katz: Oh, ok. 38
39
Karen Barrows swore in Kara Brewer. 40
41
Kara Brewer: My name’s Kara Brewer. So regarding that; what you have to do is we had to hire an 42
engineer and they do a break flow equalization which essentially shrinks the system that we need. 43
Obviously we don’t need that much water, or that much usage of it every single day, so they did it by the 44
days that we think we’re going to be using certain uses. 45
46
Barry Katz: So you don’t use that much water everyday they’re averaging it out? 47
48
35
