1 <br />Susan Halkiotis: And you guys didn’t get the appeal. Who gets the appeal? 2 <br /> 3 <br />Michael Harvey: We weren’t notified by the Court that the appeal had been filed. So to us no appeal had 4 <br />been filed. 5 <br /> 6 <br />Andy Petesch: If I could update this issue. The Brewers’ have filed a dismissal of that appeal, that was 7 <br />something that they did to preserve their right following that but it was determined that this option was 8 <br />available, they pursued it and therefore they did not pursue the appeal. 9 <br /> 10 <br />LeAnne Brown: When was it dismissed Andy? 11 <br /> 12 <br />Andy Petesch: I filed it late last week. 13 <br /> 14 <br />Susan Halkiotis: And then my last question for the time being has to do… If we go back to the wastewater 15 <br />system design. So the design requires 82,500 square feet but only 50,000 square feet are available. I mean 16 <br />how is that reconciled? 17 <br /> 18 <br />Michael Harvey: All I can testify to is in that same packet. The Health Department issued a permit 19 <br />authorizing Ms. Brewer to move forward with her project. 20 <br /> 21 <br />LeAnne Brown: As I understand it she had to use more land… 22 <br /> 23 <br />Michael Harvey: She addressed the concern and allowed the permit to be issued. 24 <br /> 25 <br />Susan Halkiotis: Ok so ultimately the 82,500 square feet were available or made available. So regarding that; what you have to do is we had to hire an 42 <br />engineer and they do a break flow equalization which essentially shrinks the system that we need. 43 <br />Obviously we don’t need that much water, or that much usage of it every single day, so they did it by the 44 <br />days that we think we’re going to be using certain uses. 45 <br /> 46 <br />Barry Katz: So you don’t use that much water everyday they’re averaging it out? 47 <br /> 48 <br />35
