Michael Harvey: Yes. 1 <br /> 2 <br />LeAnne Brown: So is it fair to say that the trip generation data given to DOT identified the use of the 3 <br />property as special events and retreat center for the purpose of counting cars? 4 <br /> 5 <br />Michael Harvey: Yes. 6 <br /> 7 <br />LeAnne Brown: Did there come a time in March that you received another building permit application from 8 <br />Ms. Brewer? 9 <br /> 10 <br />Michael Harvey: Yes, we were informed byte Building Inspections Department a revised application had 11 <br />been submitted. 12 <br /> 13 <br />LeAnne Brown: And you have the revised application? 14 <br /> 15 <br />Michael Harvey: Correct. 16 <br /> 17 <br />LeAnne Brown: May I mark it as Exhibit 11? 18 <br /> 19 <br />Michael Harvey: That’s in the Board’s packet. 20 <br /> 21 <br />LeAnne Brown: So is everything in your file there in the Board’s packet? Ok, let me mark your whole permit 22 <br />file as 11 so that we have all of it in for the record. And were you consulted as the Planning Supervisor to 23 <br />determine whether based on that application a permit was required in order for a building permit to issue? 24 <br /> 25 <br />Michael Harvey: Yes. 26 <br /> 27 <br />LeAnne Brown: And what did you determine? 28 <br /> 29 <br />Michael Harvey: After consulting with the County Attorney’s Office it became apparent the applicant was 30 <br />alleging and stipulating that the property was being developed to support an agricultural land use and 31 <br />based on the current wording in (General Statute) 153a-340 (b) (2) it was the decision that we did not have 32 <br />the authority to review the project. 33 <br /> 34 <br />LeAnne Brown: And on that basis you determined that no SUP would be required and the building permit 35 <br />process should proceed. 36 <br /> 37 <br />Michael Harvey: We are prohibited from reviewing the project from the statute because the applicant’s 38 <br />alleging farm use. 39 <br /> 40 <br />LeAnne Brown: And (inaudible) the determination was made that the interpretation of the statute prohibited 41 <br />you from reviewing the plans any further? 42 <br /> 43 <br />Michael Harvey: Correct. 44 <br /> 45 <br />LeAnne Brown: And what is different about that application from the January application? You had testified 46 <br />that in the January application you still believed a SUP was needed. What’s different? 47 <br /> 48 <br />29
