NOTICE OF MEETING <br />BOARD OF ADJUSTMENT <br />OF <br />ORANGE COUNTY, NORTH CAROLINA <br /> <br />Pursuant to the requirements of the General Statutes of North Carolina, Chapter 153A, <br />Sections 340 and 345.1, Chapter 160A Section 388, and Section 2.11 of the Orange County <br />Unified Development Ordinance (UDO), notice is hereby given that the Board of Adjustment will <br />hold a public hearing in the main Conference Room located on the Lower Level of the West <br />Campus Office Building located at 131 West Margaret Lane, Hillsborough, North Carolina on <br />Monday December 12, 2016 at 7:30 p.m. for the purpose taking specific action on the <br />following item(s): <br /> <br />1. A-2-16 – Class B Special Use Permit application proposing to erect a <br />telecommunication facility at 1941 MT. CARMEL CHURCH ROAD (PIN(s) <br />9796-09-9658 and 9797-00-5005) <br />In accordance with Section(s) 2.7 Special Uses, 5.2.2 Table of Permitted Uses, <br />5.3.2 Application of Use Standards – Special Uses, and 5.10 Standards for <br />Telecommunication Facilities of the UDO, TowerCom IV, LLC has submitted a <br />Class B Special Use Permit application seeking a permit to erect a 199 ft. tall (195 <br />ft. tall tower with a 4 ft. lighting pole at the top for a combined total height of 199 <br />ft.) monopole telecommunication facility (i.e. a telecommunication tower) on a <br />parcel of property located at 1941 Mt. Carmel Church Road, further identified <br />utilizing Orange County Parcel Identification Number (PIN) 9796-09-9658. <br />The parcel, owned by the Buckner Family Farm Trust, is zoned Rural Buffer (RB) <br />and Jordan Lake Protected Watershed Protection Overlay District and is <br />approximately 18 acres in area (hereafter ‘the property’). <br />As detailed within the application, the applicant wishes to erect a <br />telecommunication tower within a 100 foot by 100 foot leased area on the <br />property. There will be an equipment cabinet at the base of the tower to house <br />equipment for the various communication providers utilizing the tower within a 60 <br />foot by 60 foot fenced compound. <br />The proposed facility will be accessed via an existing private roadway, specifically <br />Wilbuck Lane, through a driveway extending accross an approximately 2 acre <br />parcel of property owned by Edwards Williams (PIN 9797-00-5005). This parcel is <br />a part of this application and review process. <br /> <br />The application can be viewed utilizing the following link: <br />http://www.orangecountync.gov/new_departments/planning_and_inspections/CurrentDevelopm <br />entProjects.php <br /> <br />All interested citizens are invited to attend this hearing. This is a quasi-judicial hearing <br />requiring a fair trial standard including accepting only competent, material, and substantial <br />evidence presented by parties with standing. Following the close of the public hearing, only <br />evidence presented at the public hearing will be examined by the Board of Adjustment for <br />decision. <br /> <br />Changes may be made in the advertised proposal, which reflect debate, objections, and <br />discussion at the hearing. <br />142
