v. The Rural Buffer (RB) is a general use zoning district which allows for <br />single-family residential use. <br />STAFF COMMENT: There are existing, previously approved, <br />telecommunication facilities located within the RB general use zoning <br />district, although not in proximity to this site. <br />2. Section 5.10.2 of the UDO establishes the parameters for the creation of a Master <br />Telecommunications Plan (hereafter ‘the Plan) denoting the location of properties where <br />the owner has expressed a willingness to allow for a telecommunication facility to be <br />erected. <br />The Plan indicates there is a property off of Mangum Court, approximately 3,600 ft. <br />northeast of the subject parcel, as being available for the location of a telecommunication <br />facility. Please refer to Tab(s) 1 and 11 of the application booklet for detailing why this <br />property is not suitable. <br />3. As detailed within Attachment 3 staff has determined the application is consistent with <br />established submittal requirements (i.e. application form, submittal of site plan, payment <br />of fee, etc.). The applicant has provided documentation arguing the project is compliant <br />with established development standards as detailed in Section 5.10.8 of the UDO. <br />As with all applications the Board will have to base their final recommendation on this <br />evidence as well as the sworn testimony offered during the public hearing. <br />6. There are several goals/policies detailed within the adopted 2030 Comprehensive Plan <br />addressing the development of telecommunication facilities in the County including: <br />a. Land Use Goal 1: Fiscally and environmentally responsible, sustainable <br />growth, consistent with the provision of adequate services and facilities and a <br />high quality of life. <br />b. Services and Community Facilities Goal 7: Efficient and effective public safety <br />including, police, fire, telecommunications, emergency services, and animal <br />services. <br />c. Objective PS-T-6: Develop a mechanism for cooperation with <br />telecommunication facilities stakeholders regarding the siting and design of <br />towers. <br />d. Objective PS-T-7: Manage the number of future wireless telecommunication <br />facilities by identifying preferred locations capable of accommodating service <br />Countywide. <br />e. Objective PS-T-8: Encourage the expansion of affordable, high-speed internet <br />access, fiber optic lines, and other high-speed communication networks to rural <br />and underserved areas. <br />f. Objective PS-9: Maintain a radio communication system that ensures reliable <br />notification and oversight of emergency assets, such as personnel, vehicles, <br />and response equipment, throughout Orange County and inter-operability of <br />communication among jurisdictions. <br />8. Staff held the required neighborhood information meeting (NIM) for this project on <br />October 15, 2016. Comments made at the NIM are summarized as follows: <br />a. Concerns were expressed that the tower would negatively impact adjacent <br />property values. <br />121
