Staff will review these findings in detail during <br />the public hearing. <br /> <br />STAFF COMMENT(S): <br /> <br />1. Section 5.10.8 (B) (4) (b) of the UDO establishes, as part of the application evaluation <br />criteria, a ‘hierarchy’ on the location of telecommunication facilities reading as follows: <br />Applicants for facilities shall locate, site and erect said facilities according <br />to the following priorities, in the following order: <br />a. On existing County-owned facilities without increasing the <br />height of the tower or structure. <br />b. On existing Facilities without increasing the height of the <br />tower or structure. <br />c. On County-owned properties or facilities. <br />d. On properties in areas zoned for commercial or industrial use. <br />e. On properties in areas zoned Agricultural Residential (AR). <br />f. On properties in areas zoned for residential use. <br />The applicant has the burden of demonstrating the viability of the proposed <br />telecommunication facility’s location consistent with this existing standard of evaluation. <br />It should be noted staff has determined: <br />i. There are no County owned/leased facilities in the general area of the <br />subject property allowing for the development of telecommunication <br />facilities. <br />STAFF COMMENT: The closest County owned property/facility is 2.2 <br />miles northwest, specifically the park and park-and-ride parking lot <br />within the Southern Village community within the Chapel Hill planning <br />jurisdiction. <br />ii. There are no existing facilities in the area allowing the location of additional <br />telecommunication equipment. <br />STAFF COMMENT: Please refer to Tab 30 of the application booklet <br />for the applicant’s response with respect to locating on an existing <br />telecommunication facility. <br />iii. There are no County-owned properties or facilities in the area. <br />STAFF COMMENT: Refer to our previous response. <br />iv. There are no properties zoned AR. <br />STAFF COMMENT: The area in question is located within the Rural <br />Buffer land use category as defined within the adopted 2030 <br />Comprehensive Plan. <br />There are no ‘AR’ zoned properties in this area. This would be <br />inconsistent with the aforementioned Comprehensive Plan land use <br />designation. <br />120
