of the UDO. Attachment 3 contains staff’s evaluation of the proposals compliance with the
various standards detailed within these sections. Staff will review these findings in detail during
the public hearing.

STAFF COMMENT(S):

1. Section 5.10.8 (B) (4) (b) of the UDO establishes, as part of the application evaluation
criteria, a ‘hierarchy’ on the location of telecommunication facilities reading as follows:
Applicants for facilities shall locate, site and erect said facilities according
to the following priorities, in the following order:
a. On existing County-owned facilities without increasing the
height of the tower or structure.
b. On existing Facilities without increasing the height of the
tower or structure.
c. On County-owned properties or facilities.
d. On properties in areas zoned for commercial or industrial use.
e. On properties in areas zoned Agricultural Residential (AR).
f. On properties in areas zoned for residential use.
The applicant has the burden of demonstrating the viability of the proposed
telecommunication facility’s location consistent with this existing standard of evaluation.
It should be noted staff has determined:
i. There are no County owned/leased facilities in the general area of the
subject property allowing for the development of telecommunication
facilities.
STAFF COMMENT: The closest County owned property/facility is 2.2
miles northwest, specifically the park and park-and-ride parking lot
within the Southern Village community within the Chapel Hill planning
jurisdiction.
ii. There are no existing facilities in the area allowing the location of additional
telecommunication equipment.
STAFF COMMENT: Please refer to Tab 30 of the application booklet
for the applicant’s response with respect to locating on an existing
telecommunication facility.
iii. There are no County-owned properties or facilities in the area.
STAFF COMMENT: Refer to our previous response.
iv. There are no properties zoned AR.
STAFF COMMENT: The area in question is located within the Rural
Buffer land use category as defined within the adopted 2030
Comprehensive Plan.
There are no ‘AR’ zoned properties in this area. This would be
inconsistent with the aforementioned Comprehensive Plan land use
designation.
120
