And now we’re getting the 21 <br />impression that it’s really not us but the DOT that’s responsible for doing that. Would you say that that’s so? 22 <br /> 23 <br />Michael Harvey: For the maintenance issues on Old Oak Place; yes. That’s going to be on the DOT. 24 <br /> 25 <br />Barry Katz: Ok. 26 <br /> 27 <br />Michael Harvey: But I will say one of the reasons staff recommended the condition is to try to address the 28 <br />concern of the residents and why we reached out to the DOT after the neighborhood meeting. 29 <br /> 30 <br />Barry Katz: Well it’s certainly a concern for us but we’re limited to how we address this issue. 31 <br /> 32 <br />Samantha Cabe: Any other questions for any of the applicant’s witnesses from the Board? … At this time if 33 <br />there are any witnesses for the opposition; if they could come to the microphone, state whether you’ve 34 <br />been sworn and… 35 <br /> 36 <br />Jerry Bouche: Yeah, my name is Jerry Bouche and I have been sworn. I’m the property owner at 2100 Old 37 <br />Forest Drive; which is on the corner of Old Oak and Old Forest. So the road will be right along my fence 38 <br />line there. So first of all, I’m under the impression the state maintenance ends about less than 100 feet from 39 <br />the corner of Old Oak and Old Forest because that’s where the asphalt ends. I have always maintained the 40 <br />rock and grass substrate next to my lawn. I keep it mowed during the summer and I keep the rock and 41 <br />gravel at level. I know when the state first took maintenance of the Wingate subdivision they push that 42 <br />snow right up to the edge of the asphalt and that’s as far as they go. So, I think that’s where state 43 <br />maintenance ends. My question is, for someone who will accept responsibility I think he says that the state 44 <br />transportation will have to do that. I can also tell you now that when, a year and a half ago, when they cut 45 <br />that timber they absolutely destroyed the culverts bringing those trucks in and out of this, just the one lane 46 <br />paved road throughout that subdivision. And this property gets saturated pretty quickly, it’s just grass. The 47 <br />rock that the timber company put down is gone and I can park my car… I do use that for parking sometimes 48 <br />because I have my daughter’s car, my wife’s car, my company vehicle and sometimes a company route 49 <br />12
