There is an existing County park on Erwin Road, approximately 0.75 to 1 mile south, of <br />the Kerley Road parcel. <br />The applicant has indicated the park property elevation is too low to support a tower and <br />will not address their service needs in the identified area. Please refer to Tab(s) 10, 19, <br />26, and 33 of the application packet for more information. <br />2. There is an existing telecommunication tower located approximately 1,300 ft. south of the <br />proposed site. This tower is located on property within the planning jurisdiction of the <br />City/County of Durham. <br />The applicant has indicated this existing tower is too low to accommodate their request <br />and serve their needs. <br />Per Section 5.10.8 (B) (4) (b) (vi) of the UDO wireless support structures shall not be <br />located within ½ mile of any existing monopole, lattice, or guyed wireless tower unless <br />the applicant can sufficiently demonstrate that: <br />i. Appropriate space on the existing telecommunication <br />wireless support structure is not available; or <br />ii. The applicant has made good faith effort to negotiate an <br />agreement with the owner of the existing wireless <br />telecommunication support structure and has been <br />unsuccessful, which must be documented in writing; or <br />iii. The telecommunication equipment on the existing wireless <br />telecommunication support structure is not compatible with <br />the proposed telecommunication equipment of the applicant; <br />or <br />iv. Adequate coverage by the applicant cannot be met at the <br />location of the existing wireless telecommunication support <br />structure; or <br />v. The existing wireless telecommunication support structure <br />cannot be reasonably modified to accommodate additional <br />collocation by the applicant. <br />The applicant has provided information in Tab(s) 3, 10, 19, 26, and 33 of the application <br />packet detailing their argument(s) why this existing facility is not viable for locating T- <br />Mobile’s proposed antenna. <br />3. Per Section 5.10.8 (B) (4) (b) (i) of the UDO there are no commercial and/or industrial <br />zoned properties (i.e. Orange County’s planning jurisdiction) within the applicant’s <br />identified search area allowing for the location/development of a telecommunication <br />facility. <br />4. Per Section 5.10.8 (B) (4) (b) (i) of the UDO there are no Agricultural Residential (AR) <br />zoned properties within the applicant’s identified search area allowing for the erection of a <br />tower. <br />5. As detailed within Attachment 3 staff has determined the application is consistent with <br />established submittal requirements (i.e. application form, submittal of site plan, payment <br />of fee, etc.). The applicant has provided documentation arguing the project is compliant <br />with established development standards as detailed in Section 5.10.8 of the UDO. <br />As with all applications the Board will have to base their final recommendation on this <br />evidence as well as the sworn testimony offered during the public hearing. <br />55
