Jeff Schmitt: That is my piece. Unfortunately, I have read the state statute. I know where you can and can’t do, you 1 <br />can discharge your fire arms and there is nothing that talks about the volume or velocity or the issues of noise, 2 <br />unfortunately. 3 <br /> 4 <br />Larry Wright: And there is nothing that speaks to it with a gun, with an ordinance because guns are not included in 5 <br />the noise ordinance. I think we are coming to some sort of consensus here with respect to staff’s decision. Is 6 <br />anybody willing to make a motion? 7 <br /> 8 <br />MOTION made by Karen Barrows to uphold the 2014 rescinding order made by planning staff. Seconded by Mark 9 <br />Micol. 10 <br />VOTE: Unanimous 11 <br /> 12 <br />Jeff Schmitt: I don’t know whether you phrase this as a motion but I think there needs to be. I don’t know what the 13 <br />basis by which you would be able to do this. I don’t know whether this board has the ability to decide to do that or 14 <br />not. I think there needs to be further investigation by the staff of the area contained by the witnesses is the shooting 15 <br />range. Physical presence on it, look at it, understand whether or not there are structures definitely on this thing to 16 <br />see whether or not, given that, there would be a notice that would be reissued for whatever set of reasons. 17 <br /> 18 <br />Larry Wright: Mr. Bryan, can we put this in the form of a recommendation? 19 <br /> 20 <br />Jeff Schmitt: Does anybody else agree? 21 <br /> 22 <br />Larry Wright: I am trying to talk about the feasibility of moving forward. 23 <br /> 24 <br />David Blankfard: Staff needs to do their administrative search of the “shooting area”. 25 <br /> 26 <br />Mark Micol: What did Mr. Harvey say about a warrant? What was the term? An administrative search warrant. That 27 <br />sounds like a step. 28 <br /> 29 <br />David Blankfard: He said he didn’t have enough evidence. 30 <br /> 31 <br />Mark Micol: Well, if he didn’t have enough evidence then, he is probably not going to have any going forward. 32 <br /> 33 <br />David Blankfard: Sworn testimony… 34 <br /> 35 <br />Jeff Schmitt: We have all this stuff here. 36 <br /> 37 <br />Mark Micol: What we have heard here tonight, he has already heard and he made the determination it wasn’t 38 <br />warranted then so the question is do we have the power to compel him to do that? That is what he is asking. How 39 <br />do we compel him to go out there and search the property and determine if what we heard tonight is factual. 40 <br /> 41 <br />James Bryan: If I may suggest, you all are affirming the rescinding letter. 42 <br /> 43 <br />Jeff Schmitt: The discussion we had since this is closed... the comment that Mark makes is, are we contradicting 44 <br />ourselves. Well maybe we are but maybe there needs to be some catalyst or something that occurs that would allow 45 <br />this to be re-investigated. 46 <br /> 47 <br />Mark Micol: They already said that up until the NOV was not warranted, right? So it is really going forward that if 48 <br />they call Mr. Harvey’s office tomorrow … 49 <br /> 50 <br />49
