-43- <br />In a letter, dated April 9, 2010, Orange County Planning staff informed <br />UNC representatives a Class A Special Use Permit would be required to <br />allow for a proposed expansion of the existing research facility due to the <br />size of the septic system. <br />Staff made this initial determination based on langue contained within <br />Section 6.20 of the Orange County Zoning Ordinance (now Section 3.3 <br />Residential Districts — Agricultural Residential Base Zoning District — <br />Specific Development Standards of the UDO) prohibiting the location of <br />`ground absorption systems with a design capacity of 3, 000 gallons per <br />day or more and package treatment plans for sanitary sewage disposal' <br />without the submittal, review, and issuance of a Class A Special Use <br />Permit or the approval of a Planned Development (PD) rezoning request. <br />The research facility is supported by a septic system that has a design <br />capacity to treat over 3,000 gallons of wastewater per day. <br />This determination was later reversed as detailed in a letter dated <br />November 16, 2010 where staff made a finding the Special Use Permit <br />was not required. <br />The applicant is appealing the determination that the aforementioned <br />Special Use Permit is not required as it relates to the formal approval of a <br />site plan by the County Planning Department in February of 2012. <br />REQUEST: The application requests that the Board of Adjustment overturn the <br />decision of the Planning Director to approve the site plan and require the <br />issuance of a Class A Special Use Permit as' detailed within staff's April 9, <br />2010 letter. <br />Please find attached copies of the following: <br />1.
