MINUTES <br />ORANGE COUNTY BOARD OF HEALTH <br />July 22, 1999 <br /> <br />Board of Health Minutes <br />Transcription completed by Patsy L. Bateman 5 July 22, 1999 <br /> <br />B. ADVERSE PUBLIC HEALTH CONDITION <br />The concept of the rule was first envisioned as defined in the Water and Sewer Boundary Task <br />Force Report. The definition was broadened and developed into a rule that might apply to <br />situations other than water or sewer applications. The Board considered the rule last spring and <br />requested consultation with the county attorney. After discussions with the attorney at the <br />October Board meeting, the rule was delayed for consideration pending further work and <br />clarification on the final task force report. After further consultation with the attorney, the Health <br />Director is recommending that the Board drop the Adverse Public Health Rules from <br />consideration at this time. The definitions and remedies that would be available to the Health <br />Department for enforcement of this rule would be confusing as it relates to the application <br />contained in the Water and Sewer Boundary Task Force Report. That report contains these <br />definitions with planning and zoning remedies attached and should not be confused with health <br />rules and enforcement. <br /> <br />The motion that the Board not pursue further development or adoption of the Adverse <br />Public Health Condition Rules at this time was made by Barry Adler, seconded by Mel <br />Hurston and carried without dissent. <br /> <br />VI. MOVE TO CLOSED SESSION: PERSONNEL MATTER (Authority G.S. Section 143-318.11 (a) (6)) <br /> <br />The motion to move into Closed Session: Personnel Matter (Authority G.S. Section 143-318.11 <br />(a) (6)) was made by Brenda Crowder-Gaines, seconded by Ron Cammarata and carried without <br />dissent. <br /> <br />VII. MOVE TO OPEN SESSION AND ADJOURN <br /> <br />The motion to adjourn from closed session and return to open session and approve minutes of <br />the closed session was made by Barry Adler, seconded by Jonathan Klein and carried without <br />dissent. <br /> <br />The motion to adjourn the meeting was made by Brenda Crowder-Gaines, seconded by Janet <br />Southerland and carried without dissent. <br /> <br />The Board of Health meeting adjourned at 10:45 P.M. <br /> <br />The next regular Board of Health meeting will be held on August 26, 1999 at the Government Services <br />Center in Hillsborough, North Carolina. <br /> <br />Respectfully submitted, <br /> <br /> <br />Rosemary L.
