Anne Miles 2 October 26, 2000 <br /> <br />Motion was made by Alan Rimer, seconded by Barry Jacobs and carried without dissent <br />to recommend that the Board of Commissioners re-appoint Mr. Dean Edwards as the <br />County-Appointed Cruelty Investigator for 2000-2001 <br /> <br />B. Nominating/By-Laws Committee <br /> <br /> 1. Presentation of Slate of Officers for Calendar Year 2001 <br /> <br />Janet Southerland presented the Nominating Committee report. The Committee <br />recommends a delay of presentation of slate of officers until after the Board of County <br />Commissioners has acted on a request to consider a third term for three Board of Health <br />members. These Board members received an appointment letter stating that they were <br />eligible for three terms. <br /> <br /> 2. Review of Proposed By-Laws Revisions <br /> <br />The last revision of the by-laws was in 1984. Since that time, legislative changes have <br />occurred that make revisions in some sections of the by-laws necessary in order to <br />comply with General Statutes. Other revisions are proposed based on the customary <br />practices that the Board has adopted over time. <br /> <br />The proposed revisions reorganize and reclassify the By-Laws into 1) Charge, 2) Duties, <br />and 3) Rules and Procedures. An additional change was suggested that a Conflict of <br />Interest statement be signed by new Board members. <br /> <br />The current by-laws state that revisions must be presented at the meeting prior to the <br />meeting where they are adopted, therefore these revisions cannot be adopted until the <br />November meeting of the Board. <br /> <br />C. Executive Committee <br /> <br /> 1. Receipt of Medicaid Cost Settlement Funds <br /> <br />Beginning in 1994, North Carolina chose to “set aside” a portion of annual Medicaid <br />earnings from local health departments as a potential cushion against overspending <br />those funds. Since that time, the state has not used all of the withheld funds. Last year, <br />Orange County received cost settlement funds for fiscal year 1997 – 98. <br /> <br />The allocation received in the last two years by the Health Department has been placed <br />in a capital project ordinance for use in eligible programs. Funds that are unexpended at <br />the end of the fiscal year are carried forward for use in subsequent years. <br /> <br />The funds are required to be budgeted and expended to further the objectives of the <br />program that generated the receipts. Funds may be expended for a variety of public <br />health needs and activities or they may be held in reserve for future needs of the <br />department. The funds are not to replace current budget allocations for these program <br />areas. <br /> <br />Over the past two years funds from this account have been used to purchase imaging
