MINUTES <br />ORANGE COUNTY BOARD OF HEALTH <br />September 27, 2001 <br />Board of Health Minutes Transcription completed by V. Anne Miles 3 September 27, 2000 <br />Paschall from the Board expressing concern over the lack of <br />progress on the project the Board voted to support in May. That <br />letter is being drafted. <br /> <br />Finally, staff was notified on September 17th that Mr. Paschall had <br />reoccupied at least one of the spaces vacated by the original <br />consent order. This report is being investigated and if verified as <br />correct, staff will pursue further legal action as necessary to assure <br />compliance with the consent order. <br /> <br />The County Manager and Board of County Commissioners will be <br />updated on all developments. <br /> <br />2. Request for Delay: Tyrone Trice Report <br /> <br />Mr. Trice approached the Board during it's June meeting asking for <br />a 60 day extension of his deadline to install a repair septic system <br />on his property in Bingham Township. The repair is necessary to <br />serve a relatively new modular home he has on the property. The <br />system the modular home is currently connected to is undersized <br />and encroaches on the existing well on the property. <br /> <br />The Board informally asked the staff at the June meeting to delay <br />any further enforcement actions for at least 60 days given the <br />understanding the system was not currently failing. Mr. Trice has <br />expressed his commitment to correcting the situation and has <br />received bids from two contractors. There is no current surface <br />failure of the existing system. <br /> <br />This matter went before the ACEH Committee for review on <br />September 13th. The Committee recommended that no action be <br />taken by the Board or staff until October. Should the situation not <br />be resolved by the October Board of Health meeting, the staff <br />would proceed with the usual routes of relief to achieve <br />compliance with the rules. <br /> <br />Mr. Trice provided an update to the Board on this matter and <br />requested a further extension due to extenuating circumstances. <br /> <br />Due to the fact that the existing system is not failing at this time, <br />the Board felt that a monitoring process should be set up to <br />include well water testing by the Health Department. Mr. Trice's <br />family would also be required to budget water consumption. Lee <br />Werley recommended a 6 month review of conditions and further <br />action at that time. <br /> <br />Motion to grant a 6 month extension contingent upon the system showing <br />no signs of failure, implementation of a monitoring process by the Health <br />Department and water budgeting by the Trice family was made by Lee <br />Werley, seconded by Mel Hurston, and carried without dissent. <br />
