MINUTES <br />ORANGE COUNTY BOARD OF HEALTH <br />January 17, 2002 <br />Board of Health Minutes Transcription completed by V. Anne Miles 3 January 17, 2002 <br />OCHD will be involved in the administration of the fund in the following areas: <br />• Determination of well failures <br />• Determination of the best remedy once a failure is identified <br />• Provide technical assistance and laboratory support to the residents <br />throughout the process <br />• Provide information to residents on appeals options for residents not <br />satisfied with the process <br /> <br />The ACEH Committee reviewed the draft policy and offered some changes. <br />The committee recommends that the policy go through a review by the County <br />Attorney prior to being effected. <br /> <br />The Board of Health is being asked to review the proposed process, make <br />recommendations and forward them on to the Board of Commissioners for <br />consideration. Within the process, the Board of Health is proposed to hear <br />appeals of those residents who are not satisfied with staff decisions. <br /> <br />Motion to approve the policy and process and forward them to the Board of County <br />Commissioners for consideration was made by Martha Stucker, seconded by Janet <br />Southerland, and carried without dissent. <br /> <br />2. L & W Mobile Home Park Report & Recommendations <br /> <br />Ron Holdway reported that staff issued a notice to vacate several spaces at L & <br />W Mobile Home Park in March 2001. Wayne Paschall, the owner of the park, <br />appealed the action and a hearing before two members of the Board was held <br />in April. After consideration, the full Board voted to extend the vacation <br />requirement if several conditions were met including the construction of a <br />private pump station connecting the park to the City of Durham sewer system. <br /> <br />Since that action by the Board, Mr. Paschall shelved the idea of the private <br />pump station and has instead pursued a larger scale public pump station that <br />would serve Highway 70 corridor between the Orange County line and <br />Interstate 85. The progress on that project is minimal. <br /> <br />The ACEH Committee reviewed the situation on January 8th and Mr. Paschall <br />was present along with his design engineer, Billy Walker. After hearing from <br />both Paschall and Walker, the Committee recommended that the Board delay <br />enforcement of vacation notice in accordance with the conditions detailed on <br />the report submitted to the Board. The Board indicated that this is Mr. <br />Paschall's final extension of the deadline and that he must come into <br />compliance. <br /> <br />Motion to approved a further extension to delay enforcement of vacating the spaces <br />ordered on Marcy 19, 2001 according to the conditions below was made by Martha <br />Stucker, seconded by Janet Southerland, and carried without dissent. <br /> <br />1. Mr. Paschall must have all plans reviewed, loan approvals, necessary <br />governmental approvals, and all required bonds in place by March 31, <br />2002 and must present copies of all pertinent documents regarding <br />these processes to the Environmental Health staff by that date.
