Welcome and Introductions <br /> <br />Anissa Vines, Chair, called the meeting to order at 7:00 P.M. and welcomed guests. <br /> <br />I. Approval of February 24, 2010 Agenda <br /> <br />The motion to approve the Agenda of February 24, 2010 was made by Chris Harlan, seconded <br />by Jessica Lee, and carried without dissent pending confirmation at the April BOH meeting. <br /> <br />II. Davidson Appeal Hearing Discussion <br /> <br />Mrs. Joan Davidson filed an appeal with the Health Director in accordance with NC GS 130A- <br />24. The documents for Board members to review prior to the appeal were included with the <br />Agenda packet mailed the week prior to the meeting. Ms. Davidson waived the 10 day <br />notice prior to the hearing and agreed to have the appeal at this meeting. <br /> <br />In her appeal letter Ms. Davidson requested the addition of an emergency provision to the <br />Orange County Water Protection Rules and/or the Orange County Environmental Health <br />Division Policies that would allow for default to the NC State Geothermal Well Construction <br />Standards in special cases that are brought before the board where the use of these less <br />stringent rules would not cause potential hazards to environmental degradation or public <br />health and would allow for fairer or more cost efficient geothermal installation than the current <br />County standards allow. She asked approval of her case as one such exception. <br /> <br />The Board of Health is governed by NCGS 130A-24 (c): The local board of health shall hold a <br />hearing within 15 days of the receipt of the notice of the appeal. The board shall give the <br />person not less than 10 days’ notice of the date, time and place of the hearing. On appeal, <br />the board shall have authority to affirm, modify or reverse the challenged action. The local <br />board of health shall issue a written decision based on the evidence presented at the hearing. <br />The decision shall contain a concise statement of the reasons for the decision. <br />
