Orange County & NCDOT Highway Luncheon Meeting Notes <br />Division 7 and District 1 <br />November 30, 2017 12:00 p.m. <br />The final plats for the subdivision were recorded between 1993 and 1995. This <br />request includes a petition for five road additions to the State System: <br />Serrano Way, Madera Lane, Umbrio Lane, Majestic Court, and Chimeneas <br />Place, which were designed to public road standards. <br />There are two additional roads in the subdivision, Bolinas Way and Bolinas <br />Court, which were platted as private roads and therefore not eligible for <br />addition to the State System. Another road in the subdivision, Rhododendron <br />Drive (SR 2060), is already in the State System. <br />Status: Abigaile Pittman stated that the three NCDOT petitions for road <br />addition are going forward to the December 4 BOCC agenda. The <br />recommendation for all the petitions is for the BOCC to forward the Petition <br />for Addition to the State Maintained System to the NCDOT recommend the <br />DOT accept the roads for maintenance as State Secondary Roads. <br />c) Arthur Minnis Road (Update) (NCDOT /Craig Benedict) <br />Right -of -way Acquisition: Begin acquisition process for Orange County funds <br />necessary for NCDOT implementation and compensation (2018 -19) <br />Safety Improvement: Steps toward paving the unpaved section of Arthur <br />Minnis Road between New Hope Church Road and Orange Grove Road. <br />Chuck Edwards, NCDOT stated that this unpaved section of Arthur Minnis <br />Road has been in its present unpaved condition and discussed for over thirty <br />years, and has been on NCDOT's hold list because additional right -of -way is <br />needed to pave the road in front of four houses where right -of -way has not yet <br />been obtained. He noted that NCDOT does have majority of the right -of -way <br />and was able to obtain dedicated right -of -way from one property owner but <br />does not have the necessary connectivity to the road. He stated that the last <br />negotiation efforts NCDOT had with the remaining property owners was in <br />September, 2016, but that they had had no response from any of them as of <br />today. <br />Chuck Edwards stated that NCDOT has the legal ability to condemn properties to <br />acquire the necessary right -of -way in accordance with North Carolina General <br />Statute 136 -44.7 which states "if one or more property owners have not <br />dedicated the necessary right -of -way and at least 75 percent of the owners <br />adjacent to the project and the owners of a majority of the frontage (i.e. greater <br />than 50 %) must have dedicated the necessary property for the right -of -way; <br />These conditions are currently met on the subject section of Arthur Minnis Road <br />since NCDOT currently has 76 percent of the properties. Also, required funds to <br />cover condemnation costs must be provided. The cost for condemnation would <br />be maximum $2,500 per parcel plus any damages identified by any appraisal as <br />per 19A NCAC 02C.0108. NCDOT could fund and pave the road if the right -of- <br />way and fees are available. <br />55 <br />
