ORANGE COUNTY <br />BOARD OF COMMISSIONERS <br />ACTION AGENDA ITEM ABSTRACT <br />Meeting Date: November 14, 2006 <br />Action Age da <br />Item No. ~Q <br />SUBJECT: Approval of CHCCS Elementary #10 Property Exempt Subdivision Ownership <br />Sianoff <br />DEPARTMENT: Planning/Budget <br />PUBLIC HEARING: (YIN) No <br />ATTACHMENT(S): <br />Plat <br />INFORMATION CONTACT: <br />Craig Benedict , (919) 245-2585 <br />Donna Coffey, (919) 245-2151 <br />PURPOSE: To authorize the Chair of the Board of County Commissioners to sign the exempt <br />subdivision plat for Chapel Hill-Carrboro School District Elementary #10. <br />BACKGROUND: The County purchased 4 lots of record in 2001 totaling 193 acres for the <br />Twin Creeks Park and Educational Campus. The northernmost lot (previously known as the <br />Hunter. Tract), totaling 44 acres, is adjacent to Eubanks Road. A portion of this tract is now <br />under Conditional Use Permit review by the Town of Carrboro for the construction of Chapel <br />Hill-Carrboro School District Elementary #10. The process required an area delineation of what <br />property would be specifically subject to the Conditional Use Permit and coriditions. <br />Since only approximately 19 acres of the 44 acres is necessary to build the school, the property <br />can be subdivided into two parcels (one 19 acres and the other 25 acres) to limit the Conditional <br />Use Permit encumbrances only to the one parcel. State law and local government <br />implementation allows property owners (in this case Orange County) to subdivide a parcel into <br />lots larger than 10 acres through an `exempt' subdivision process with limited and expeditious <br />review by the local government. <br />In this case, Orange County is the property owner and this agenda item creates an <br />acknowledgement by the Board of County Commissioner and authorizes the Chair to sign the <br />ownership certificate in the `exempt plat.' <br />FINANCIAL IMPACT: Adequate funding is already included in the BOCC-approved <br />Elementary #10 Capital Project to complete this survey and platting work. <br />RECOMMENDATION(S): The Manager recommends that the Board authorize the Chair to <br />sign the ownership certificate for the subject property. <br />
