(D) <br />Article 6: Development Standards <br />Section 6.13: Stream Buffers <br />(5) Archaeological activities /projects conducted in accordance with all applicable <br />County, State and Federal regulations. <br />(6) Dam /reservoir maintenance activities. <br />(7) Maintenance of existing outfalls provided they are managed to minimize the <br />sediment, nutrients, and other pollution that convey to waterbodies. <br />(8) Driveway crossings on single - family residential lots that disturb less than, or <br />equal to, 25 linear feet or 2,500 square feet of stream buffer. <br />(9) Greenways and /or hiking trails six feet in width composed of natural materials at <br />least 30 feet from the top of bank of a stream or water body. <br />(10) Historic preservation projects /activities. <br />(11) Periodic maintenance of modified natural streams, such as canals, and a <br />grassed travel way on one side of the surface water when alternative forms of <br />maintenance access are not practical. <br />(12) Public water and sewer lines that do not disturb over 40 linear feet. <br />(13) Stream restoration and /or stream bank stabilization. <br />(14) Wetland restoration, in accordance with all applicable County, State and Federal <br />regulations. <br />(15) Vegetation management, including but not limited to: <br />(a) Emergency fire control measures provided that topography is restored; <br />(b) Planting vegetation to enhance the riparian buffer; <br />(c) Pruning forest vegetation provided that the health and function of the <br />forest vegetation is not compromised and the pruning activity is <br />conducted by hand; <br />(d) Removal of individual trees which are in danger of causing damage to <br />dwellings, other structures or human life provided the activity is <br />conducted by hand; and <br />(e) Removal of poison ivy and other nuisance vegetation, including invasive <br />exotics, as identified by the NC Cooperative Extension. <br />Uses Allowable With Mitigation <br />The following uses are allowable within stream buffers with mitigation, subject to the <br />standards established in Sections 6.13.6(A) and 6.13.6(B) above, as well as any specific <br />standards for the use: <br />(1) Water dependent structures, such as docks, piers, public and private boat ramps, <br />boat houses over the water, walkways, water recreational amenities, and other <br />similar uses. <br />(2) New drainage outfalls provided that a stormwater management facility is installed <br />to control nutrients and attenuate flow before the conveyance discharges into the <br />stream buffer. <br />(3) Driveway crossings on single - family residential lots that disturb less than, or <br />equal to 150 linear feet or 1/3 of an acre of stream buffer. <br />(4) Any driveway or roadway, whether for a single - family residence or a subdivision, <br />that is parallel to the stream or water body, regardless of cumulative impact. <br />(5) Greenways and /or hiking trails six feet in width, with improved paths (i.e. paved, <br />wood decking, etc.) at least 30 feet from the top of bank of a stream or water <br />body. <br />Orange County, North Carolina — Unified Development Ordinance Page 6 -99 <br />
