45 <br />11/23/15 Page 2 of 3 <br />BOCC Impact of SL 2015 -246 (HB 44) on Orange Co. <br />These are the rules which form the basis of the stormwater regulations for almost half of <br />the County. In the absence of these rules, research will need to be done to determine <br />how the UDO would need to be modified in order to meet the requirements of state law. <br />Unfortunately, the North Carolina Department of Environment and Natural Resources <br />Energy Mineral and Land Resources (DEMLR) is right in the middle of a comprehensive <br />review of stormwater regulations, which involves significant reorganization, repeals of <br />duplications and amendments. Why is DEMLR doing this? <br />#1 S.L. 2013 -82 requires new rules for Fast -Track permitting. Minimum Design <br />Criteria (MDC) are part of the Fast -Track requirements, so they have to be <br />codified too. <br />#2 G.S. �15013-213A directs state agencies to review and update their rules every <br />10 years. <br />#3 It's a good opportunity to update & streamline. <br />Substantive changes resulting from this that will affect Orange County include: <br />1. Minimum Design Criteria (MDC) and fast -track permitting <br />2. Project density <br />3.
