Petition Letter & SR Addition Investigation <br />RepoAs for Ezekiel Peppers Trail and <br />Jubilee Drive <br />PURPOSE: To consider a recommendation regarding petitions to add Ezekiel Peppers Trail <br />and Jubilee Drive to the State Maintained Secondary Road System. <br />BACKGROUND: Property owners on Ezekiel Peppers Trail (entrance access road to the <br />subdivision) and Jubilee Drive (11 homes) have petitioned the North Carolina Department of <br />Transportation (NCDOT) to accept maintenance responsibilities for those roads. Ezekiel <br />Peppers Trail and Jubilee Drive are located in New Homestead Place Subdivision off the east <br />. <br />side of Rogers Road, Chapel Hill Township. New Homestead Place was approved by the <br />Chapel Hill Town Council in 1995. The subdivision is located in Chapel Hill's planning <br />jurisdiction (in the transition area) outside the Chapel Hill municipal limits. <br />NCDOT has investigated these requests, (please refer to attached Secondary Road Addition <br />Reports), and has submitted the petitions to the Board of Commissioners for its review and <br />recommendation. In accordance with North Carolina General Statute §136-62* the Board must <br />take an administrative action to make a recommendation - regarding the petitions to the North <br />Carolina Board of Transportation before the NC Board of Transportation (NCBOT) can consider <br />the petitions. <br />* North Carolina General Statute §136-62 directs that "The citizens of the State shall have the right to present <br />petitions to the board of county commissioners, and through the board to the Department of Transportation, <br />concerning additions to the system and improvement of roads. The board of county commissioners shall receive <br />such petitions, forwarding them on to the Board of Transportation with their recommendations..." <br />
