Benedict, Planning Director <br />DATE: September 5, 2006 <br />SUBJECT: Westhampton; .Joint Planning Area Agreement and Land Use <br />Plan and Greenways <br />CC: Geoff Gledhill, County Attorney <br />Research shows that the Rural Buffer land use description and the 'Resource Protection <br />Areas' as defined in the JPA (with associated greenway connector pathways) are areas <br />where the County currently has the authority to require public access to and "greenway" <br />dedications. <br />The County has used its authority to require dedications for public access to greenways <br />on both sides of the Westhampton site in past years (1988 Turtledove subdivision and <br />1992 Shenandoah subdivision). (See attached map.) This dedication requirement is <br />consistent with the similar JPA implementation strategies and requirements of our JPA <br />partners, Carrboro and Chapel Hill, each of which have similar language requiring <br />greenway public dedications for their respective transition areas. The operative <br />language from the JPA Land Use Plan is as follows: <br />"These areas form the basis for a comprehensive parks and open space <br />system which provides the framework within which other land use <br />categories are to function. Parks have been generally located throughout <br />the Joint Planning Area using a neighborhood park one-half mile service <br />radius.
