We hereby provide our response to each recommended
Condition of Approval below.
1. The intersection and road alignments on the Preliminary Plan shall meet
NCDOT collector standards with a 60-foot right-of--way and 34-foot B-B
pavement, The sidewallt is to he outside of the right-of--way.
Applicant's .Response: We have met with NCDOT to discuss whether or not
Westhampton Way should be classified and constructed as a collector street, After
revisiting this issue and meeting with the developer at the site, the NCDOT District
Engineer has agreed that Westhampton Way should not be classified as a collector
street. Accordingly, NCDOT has indicated to us that a 27-foot back-of=curb to back-
of-curb street (which is their standard street width), located in a 50-foot wide right-of-
way, would be the appropriate design cross-section for Westhampton Way and all
other Westhampton streets.
2. Fomeowners Association documents that provide for maintenance of the Open
Space shaII be submitted with the preliminary plan, Provisions shall he included
in the Homeowners Association documents that would prohibit tree cutting in
the Open Space except for maintenance purposes.
Applicant's Response: We have included the proposed "Declaration of Covenants,
Conditions and Restrictions of Westhampton" with our Major Subdivision
Preliminary Plat submittal. Please note that Article X (Use Restrictions), Section 16
(Open Space Maintenance) includes appropriate language stating that tree cutting in
the open space areas shall be prohibited except for maintenance purposes.
ii~esthampmn -Response to Staff Connnenlr
RTarch ZZ, Z006
Page ! of a
