Margaret Lane <br />Suite 201 <br />Hillshorough, NC 27278 <br />Dear Craig., <br />Oakwood Solar Farm, LLC had discussed with staff a 6 -month extension: to the Class A Special Use Permit <br />issued on September 19, 2016. However, there was a conditlon in the Permit requiring a Conservation <br />Easement to be created for the area encumbered by the SFHA Overlay District on the site. After working <br />very closely with the County to create the easement, i t was m Attu a Ily ag reed that It wou Id he rnore efficient <br />and meet the intent to amend the condition to create an undisturbed area on the property encumbered <br />by the SFHA Overlay District. As a result, this change in a condition would be a modification to the Permit <br />under UDO Section 2.7.15 and prevent us from extending the Permit. With that said, we would like to <br />request a modification to the Special Use Permit to change condition 1 of the Permit to read as follows: <br />The applicant shall coordinate with the landowner to create an undisturbed area on the property <br />encumbered by the SFHA Overlay District. The applicant shall cause the landowner to submit a letter to <br />the Orange County Planning Department agreeing to the establishment of the undisturbed area within <br />180 days approval of the rnodiflcation. <br />if you have any questions, please feel free to contact me.
