4 <br />The developer indicated in the June 7, 2006 Planning Board meeting they did not see a need far <br />condition E.3. in the Resolution of Approval "Provide a 20 foot public access easement from <br />Westhampton Way to the dedicated open space along Phil's Creek," They were concerned about <br />the public parking on Westhampton Way and walking across the open space to Phil's Creek. <br />• Second Action: Planning Board on .June 7, 2006 unanimously recommended approval with the <br />deletion of E,3, from the Resolution of Approval. <br />• Third Action: <br />1. The Board shall consider the application within a reasonable amount of time, <br />2. During deliberations and consideration of the application the Board may defer <br />consideration at any point to pursue additional analysis and review. <br />3. If the Preliminary Plan is approved by the County Commissioners, the applicant shall have <br />one (1) year to prepare and file a Final Plat or to request aone-year extension from the <br />Planning Director, <br />FISCAL IMPACT: The Fiscal Impact Analysis is included as an attachment., <br />RECOMMENDATION(S): Administration Approval, in accordance with the attached Resolution of <br />Approval which includes item E, 3, <br />Planning Board Approval, in accordance with the attached Resolution <br />of Approval with item E. 3 deleted from Resolution, <br />Planning Staff Approval, in accordance with the attached Resolution of <br />Approval with a condition E. 3.
