3 <br />• The closest water and sewer is in Rangewood subdivision, which is approximately 1,000 feet <br />north of this subdivision. <br />• Extension of water and sewer is prohibited in the Rural Buffer except for a public purpose or to <br />address a health situation. <br />Recreation: <br />• Chapel Hill District Park <br />• The Orange County Environment and Resource Conservation Department is recommending a <br />portion of the open space property be dedicated to Orange County for recreation and open <br />space, The proposed dedication is a 200-foot-wide strip located parallel to a 770 foot segment of <br />property boundary formed by Phil's Creek and a 200-foot-wide strip located parallel to a 150 foot <br />section of Phil's Creek that helps to form the southwestern property boundary (memo and map <br />attached), Payment in lieu would require 1/20th of an acre per lot which would be approximately <br />41,382 square feet. This dedication of 4.5 acres would replace the payment-in-lieu option,. <br />Development Process Schedule and Action <br />Planning Board: <br />First Action: Concept Plan approved by the Planning Board December 7, 2005 with the <br />following conditions; <br />1. The intersection and road alignments on the Preliminary Plan shall meet NCDOT <br />collector standards with a 60 foot right-of-way and 34 foot B-B pavement. The sidewalk is <br />to be outside of the right-of-way,(NCDOT Recommendation) <br />2. Homeowners Association documents that provide for maintenance of the Open Space <br />shall be submitted with the preliminary plan. Provisions shall be included in the <br />Homeowners Association documents that would prohibit tree cutting in the Open Space <br />except for maintenance purposes. <br />3, The cul-de-sac at the end of Westhampton Way shall be increased to a minimum of 95 <br />feet in diameter, Turning radii at all corners shall have a 32 foot minimum, <br />4_ Show proposed dedication of an additional 5 feet of right-of-way, or 35 feet from C/L of <br />existing R/VV, whichever is greater, along Hatch Road on the Preliminary Plan, <br />5. Weston Lane must have 4 lots accessing it to meet NCDOT requirements, <br />6. Show five-foot utility easements along both sides of all rights-of-way. <br />7. ERCD has recommended that a portion of the open space be dedicated (deeded) to <br />Orange County for recreation and open space, The dedication is a 200-foot-wide strip <br />located parallel to a 770 foot segment of property boundary farmed by Phil's Creek. This <br />will meet the requirement for recreation and reduce or eliminate the amount of the <br />recreation payment-in-lieu. <br />8. Shaw location of subdivision sign on Preliminary Plan. <br />9. Any lighting shall meet Orange County Outdoor Lighting Standards, <br />10, A minimum 50 foot wide Pedestrian Open Space Area (POSA) shall be provided between <br />lots 7 and 8. <br />Preliminary Plan: Addresses the conditions of approval of the Concept Plan. The applicant has <br />submitted responses to Staff comments and responses to Planning Board comments from the <br />December 7, 2005 meeting. Subdivision streets are designed, as required by NCDOT, to "local <br />subdivision road" minimum design standards for rolling terrain. Items of concern to the Planning <br />Staff are dedication of open space to Orange County along Phil's Creek and Pedestrian Open <br />Space Areas (POSA) needed between lots 3 & 4 and between lots 9, 10 & 11. Additional conditions <br />have been added to the Resolution of Approval to meet these concerns. Several neighbors in the <br />.June 7, 2006 Planning Board meeting indicated they had not encountered problems but were <br />concerned with water quality (see attached minutes), <br />
