We hereby provide our response to each recommended <br />Condition of Approval below. <br />1. The intersection and road alignments on the Preliminary Plan shall meet <br />NCDOT collector standards with a 60-foot right-of-fvay and .34-foot B-B <br />pavement. The sidewall< is to be outside of the right-of--way. <br />,4pplicar:f's Response: We have met with NCDOT to discuss whether or not <br />Westhampton Way should be classified and constructed as a collector street.. After <br />revisiting this issue and meeting with the developer at the site, the NCDOT District <br />Engineer has agreed that Westhampton Way should not be classified as a collector <br />street. Accordingly, NCDOT has indicated to us that a 27-foot back-of=curb to back- <br />of-curb street (which is their standard street width), located in a 50-foot wide right-ot- <br />way, would be the appropriate design cross-section for Westhampton Way and all <br />other Westhampton streets <br />Z, Homeowners Association documents that provide for maintenance of the Open <br />Space shall be submitted with the preliminary plan. Provisions shall be included <br />in the Homeowners Association documents that Fvould prohibit tree cutting in <br />the Open Space except for maintenance purposes, <br />Agplicant's Resporae: We have included the proposed "Declaration of Covenants, <br />Conditions and Restrictions of Westhampton" with our Major Subdivision <br />Preliminary Plat submittal.
