CONDITION 3 (Utilities) — Add a new subsection (e) reading as follows: <br />(e) Looped water systems maybe required to provide necessary water flow and pressure within <br />each development district. These requirements and ultimate improvements are the responsibility <br />of the developer. <br />2. CONDITION 5 (Transportation) —Anew subsection (c) to read as follows: <br />(c) Development of District 1 shall utilize the existing Service Road to obtain access to Old NC <br />Highway 86. At the time development in District 1 exceeds allowable traffic trips, as defined <br />within the Master Traffic Impact Analysis (TIA), requiring a restriction /prohibition on left turn(s) <br />off of Service Road onto Old NC Highway 86 (other than a traffic signal at this intersection) an <br />alternative traffic alignment /improvement shall be required to serve District 1 which will allow <br />for both left and right turn access onto Old NC Highway 86. This alternative, with substantiating <br />TIA, shall be reviewed and approved by Orange County and the NC Department of <br />Transportation and shall be installed in conjunction with the site development that generates the <br />traffic that exceeds the above defined threshold. These improvements are the responsibility of <br />the developer. <br />3. CONDITION 5 (Transportation) —Anew subsection (d) to read as follows: <br />(d) Internal roadways within District 1 shall have dedicated right -of -ways extended to property <br />lines to serve adjacent property at no more than two locations. <br />4. CONDITION 13 (Land Use) — under Subsection (ii) addressing development in District 2 the <br />following new language shall be added related to the permitting of retail land uses: <br />Retail - limited to 30% of the allowable floor area of District 2 not to exceed 78,500 sq.ft. of total <br />cumulative floor area. <br />Michael D.
