He said the current language could be interpreted to allow appeal of every 3 <br />action that the Animal Services Department takes to the hearing pool and the Superior 4 <br />Court. He said this was not the intent of the language. 5 <br />Commissioner McKee asked if one is able to appeal in all cases anyway. 6 <br />John Roberts said one can always sue the County. 7 <br /> 8 <br />Chapter 6 9 <br />Insulation Contractors Ordinance - Obsolete and no longer enforced. The state building 10 <br />code has been amended substantially since this ordinance was adopted. The state 11 <br />building code now allows contractors to engage numerous alternative compliance 12 <br />methods that circumvent the ordinance. 13 <br />John Roberts said if the BOCC is comfortable with repealing this, he would 14 <br />recommend that division 1 be left in place, with some amending of the language as to the 15 <br />insulation that is put in County buildings. 16 <br />Commissioner Marcoplos clarified that this law would be in place only for County 17 <br />buildings. 18 <br />John Roberts said yes, if the BOCC is interested in this. 19 <br />Commissioner Marcoplos asked if this could be achieved via a contract as 20 <br />opposed to a law. 21 <br />John Roberts said yes it could. 22 <br />The Board agreed to add this language to contracts instead of an ordinance and 23 <br />to repeal the ordinance. 24 <br /> 25 <br />Chapter 10 26 <br />Cable Communications Ordinance - Governs franchises and thus not appropriate for the 27 <br />Code of Ordinances as franchise ordinances are maintained separate and apart from the 28 <br />Code. John Roberts recommended the Board remove from Code and maintain as a 29 <br />separate franchise ordinance template for possible repeal at a later date. The County’s 30 <br />franchise with Time Warner expired in 2009 and the authority for granting and renewing 31 <br />such franchises was withdrawn by the legislature in SL 2006-151 32 <br />The Board agreed. 33 <br /> 34 <br />Chapter 16 35 <br />Noise Ordinance - Board members previously indicated the board may wish to amend 36 <br />the noise ordinance. 37 <br /> 38 <br />John Roberts said Board members have expressed some concerns about this. 39 <br />He said section 16-52 is different from section 16-53, with the difference being that 16-52 40 <br />prohibits specific actions on a property from 9:00 p.m. to 9:00 a.m.…lawn mowers, chain 41 <br />saws, compression engines, etc.; and section 16-53 refers to the decibel measurement 42 <br />restrictions come into play. 43 <br />John Roberts said this item is for Board discussion. 44 <br />Commissioner Rich referred to “unreasonably loud,” and asked if this is 45 <br />considered in the meter measurement on 16-53, or if it is a subjective opinion. 46 <br />John Roberts said unreasonably loud is defined on page 7. 47 <br />Commissioner Marcoplos clarified that if one is more than 300 feet away, then the 48 <br />law is not applicable. 49 <br />John Roberts said yes. 50 <br />Commissioner Marcoplos said a friend, who owns land near him, had another 51 <br />friend who wanted to test a semi-automatic weapon. He said this land is about 300 yards 52 <br />away from his own house, but the shooting sounded as though it were in the back yard. 53
