Proposed Phase III Program Design <br />and Ordinance Development <br />INFORMATION CONTACT: <br />Craig Benedict, 245-2592 <br />Glenn Bowles, 245-2577 <br />Louis Berger Group/UNC-Charlotte <br />PURPOSE: To receive the consultant's draft report on the TDR Feasibility Study and to <br />consider the recommendation of the TDR Task Force that the process of designing a TDR <br />program should go forward. <br />BACKGROUND: The Louis Berger Group/UNC-Charlotte Urban Institute consultant team held <br />its sixth meeting with the TDR Task Force on June 6, 2006. Following a presentation, Task <br />Farce member Ed Holland (OWASA representative) made the following motion with a second <br />by Town Commissioner Mike Gering (Town of Hillsborough representative): "A TDR program is <br />philosophically, legally, and politically feasible, there are no legal or administrative impediments <br />for such, and the process of designing a program should go forward." All eight members <br />present voted in the affirmative, <br />The recommendation of the Task Farce is the culmination of nearly ten months of deliberations, <br />which included six meetings and one public meeting, and over a year of consultant and multi- <br />department staff efforts, The consultant contract included a feasibility study of two phases: <br />Phase I. Background Research and Data Collection <br />• Phase II. Generate and Review TDR Options (Feasibility Study and Concept Plan) <br />A draft Orange County Transfer of Development Rights Feasibility Study "Summary of Findings <br />and Recommendations" is available for BOCC consideration. In the draft summary, the <br />following findings are presented: <br />1, Legal Feasibility <br />a. Orange County can rely on its existing authority to purchase conservation easements, <br />award density bonuses, designate sending and receiving areas, and establish <br />eligibility, bonus limit criteria, and establish varying levels of development bonuses, <br />
