In exercising this power, the Board is bound by the State ena• ng legislation, the <br /> t: ms of this Ordinance, and applicable court decisions in carrying • t its legislative <br /> fun.tion. <br /> (B) Hear . d decide applications for the approval of Class A Spe ..I Use permit as noted in <br /> the Sch.•ule of Permitted Uses as requiring approval of the oard of Commissioners, <br /> which sha be processed in accordance with the provisio . detailed herein. In exercising <br /> this power, ,e Board is bound by the State enabling leg•slation, the terms of this <br /> Ordinance, an applicable court decisions in carrying •ut its decision making function <br /> within a quasi-ju.icial capacity and shall make its d: isions based on substantial <br /> evidence containee in its record of proceedings -'d shall be bound by the general and <br /> specific standards a • requirements of the pa • ular Special Use as defined herein. <br /> (C) Hear and decide applic- ions appealing tho - decisions appealed to the Board of County <br /> Commissioners. <br /> (D) Establish Rules of Procedur- for the c. duct of hearings and other proceedings before <br /> the Board of County Commissioners *n exercising responsibilities identified herein. <br /> (E) Make the necessary appointmen : to the Planning Board and Board of Adjustment. <br /> (F) Provide, by appropriation, fun• for t• - administration of this Ordinance. <br /> SECTION 1.4: PLANNING DIRECTOR <br /> 1.4.1 Responsibilities <br /> (A) The Planning Dire► or, or his/her designee, shal ave the responsibility for the <br /> administration, it erpretation, and enforcement of is Ordinance. <br /> (B) Within this 0 finance, `Planning Director' is synonymous with the individual actually <br /> serving in •at capacity or a designated employee unle . otherwise specified. <br /> (C) The PI-•ning Director is an employee of the County hired o and reporting to the County <br /> Man-•er and shall have the following duties in respect to thi• Ordinance: <br /> (1 Administering all provisions of this Ordinance for which .dministrative <br /> responsibilities are not otherwise expressly assigned; <br /> (2) Making interpretations of the provisions of this Ordinance; <br /> (3) Reviewing all applications submitted in accordance with the requirements of this <br /> Ordinance to ensure compliance with the provisions of this Ordin-Ice; <br /> (4) Coordinating County staffs compliance with duties and responsibiliti-. specified <br /> in this Ordinance; <br /> 4 As we are eliminating the Special Flood Hazard Area Overlay District,these provisions are no longer necessary. <br /> Orange County, North Carolina—Unified Development Ordinance Page 1-9 <br />
