Article 2: Procedai1 s <br /> Section 2.7: Special Use Permits <br /> (D) If a watercourse is to be altered or relocated, the following shall be submitted by the <br /> permit applicant prior to issuance of a floodplain development permit: <br /> (1) A description of the extent of watercourse alteration or relocation; <br /> (2) An engineering report on the effects of the proposed project on the flood-carrying <br /> capacity of the watercourse and the effects to properties located both upstream <br /> and downstream; and <br /> (3) A map, drawn to scale, showing the location of the proposed watercourse <br /> alteration or relocation. <br /> (E) For applications for building permits to improve buildings and structures, including <br /> alterations, movement, enlargement, replacement, repair, change of occupancy, <br /> additions, rehabilitations, renovations, substantial improvements, repairs of substantial <br /> damage, and any other improvement of or work on such buildings and structures, the <br /> Floodplain Administrator, in coordination with the Building Official, shall: <br /> (1) Estimate the market value, or require the applicant to obtain an appraisal of the <br /> market value prepared by a qualified independent appraiser, of the building_or <br /> structure before the start of construction of the proposed work: in the case of <br /> repair, the market value of the building or structure shall be the market value <br /> before the damage occurred and before any repairs are made; <br /> (2) Compare the cost to perform the improvement, the cost to repair a damaged <br /> building to its pre-damaged condition, or the combined costs of improvements <br /> and repairs, if applicable, to the market value of the building or structure; <br /> (3) Determine and document whether the proposed work constitutes substantial <br /> improvement or repair of substantial damage; and <br /> (4) Notify the applicant if it is determined that the work constitutes substantial <br /> improvement or repair of substantial damage and that compliance with the flood <br /> resistant construction requirements of the NC Building Code and this ordinance <br /> is required.22 <br /> (-E)(F).__,Certification Exemptions <br /> The following structures, if located within Zone AE, are exempt from the elevation/flood <br /> proofing certification requirements specified in items (A) and (B) above: <br /> (1) Recreational vehicles meeting requirements of Section 6.621.1(B)(5);23 <br /> (2) Temporary structures meeting requirements of Section 6.621.1(B)(7); and <br /> (3) Accessory Structures with any dimension that is 12 feet or greater in height, <br /> width, or depth, meeting requirements of Section 6.621.1(B)(8). <br /> SECTION 2.7: SPECIAL USE PERMITS <br /> 2.7.1 Generally <br /> (A) Any use or develop -- •esignated by applic.- - zoning district regulations contained <br /> within Article 5 as a special us-, . as - • ed only pursuant to a special use permit <br /> (either Class A or Class B), - se es .• ' ed in that district only after the use or <br /> development is autho ' -. .y a validly issued an. - orded special use permit. <br /> (B) This sect'.- ets forth required review and approval procedure , submittal, review, and <br /> a.-.• al of applications for special use permit. <br /> 22 Subsection (E) is new language being incorporated to remain consistent with the FEMA model flood ordinance. <br /> 23 Section references update to reflect the new location of the flood regulations within the UDO. <br /> Orange County, North Carolina—Unified Development Ordinance Page 2-18 <br />
