The Special.Use Permit is important because the County can attach.. <br />conditions of approval to that permit which bind the applicant to those <br />specific conditions which generally attempt to address or mitigate impacts <br />which are identified in the site plan review and approval process. If a <br />second hearing is held, it will occur on November 23, 1992. <br />Marvin. Collins presented the staff analysis and recommendation <br />which is included in the agenda abstract. He noted that- while "neo- <br />traditional" community planning is new to Orange County, there are other <br />similar projects both in this state and nationally. <br />QUESTIONS FROM COUNTY COMMISSIONERS OR PLANNING HOARD MEMBERS <br />Marvin Collins clarified that those areas designated transition <br />would become the jurisdiction of the Town of Hillsborough and eligible for <br />annexation to the Town of Hillsborough. If a transition area designation <br />was approved by the County, it would be the hope of the planning department <br />that when the site plan and the rezoning and special use permit approvals are <br />sought, that the plan that is submitted would be entirely consistent with the <br />planned community open space strategy. This would make it possible for these <br />629 acres to be designated as part of the open space area. <br />Commissioner Insko asked about the 377 acres in open space and the <br />provisions that would ensure that this area be maintained as open space in <br />perpetuity. Collins stated that, as a part of the planned development <br />application,. the golf course would be shown on the site plan. When the plan <br />is approved, the special use permit must be recorded and the developers would <br />have to carry out the plan. If they wanted to make any other use of this <br />area, they would have to seek approval from the County Commissioners because <br />it would constitute a major modification to the original plan and require a <br />public hearing. He explained several options for assuring that the area <br />remain open space. Geoffrey Gledhill explained that the land itself could <br />be dedicated as open space which even at a later date could not be changed <br />through modification of the special use permit. <br />Marvin Collins noted that this project would be carried out over <br />ten years with the first phase being the construction of the golf course. <br />The developers could begin construction of the golf course within the first <br />six months after approval and continue to build without letting six months <br />pass with no construction. If this land remains in transition as a part of <br />the Cooperative Area Land Use Plan, the permitting process would pass from <br />the County to the Town of Hillsborough. However, if this site and the zoning <br />of this site were in some category of open space district or open space area, <br />it would stay with the County. <br />Commissioner Halkiotis made reference to the statement in the <br />document that 25 acres will be designated for a park as well as a site for <br />fire and rescue stations and asked if this was a separate parcel of land. <br />Marvin Collins indicated that this is his understanding. Halkiotis asked <br />that they consider combining fire, rescue and sheriff services. <br />
