July 6, 1992 <br />To: Orange Co. Planning Staff <br />Attn: Eddie Kirk <br />Re: Phase III Heartwood Subdivision <br />Please receive for your review and information the following <br />preliminary plan for Heartwood Phase III. We propose using 19.534 <br />acres of Dickinson land for 9 fee simple lots. Lots would average 1.3 <br />acres in size and the balance of the 2 acre minimum, approximately <br />5.74 acres, will be in common land. There will be an area around the <br />lot arrangement set aside for a trail easement, where residents can <br />have full access to all common areas. This easement will also allow <br />the farm and the Community Building access to Duke Forest. The <br />addition of the 5.74 acres to the Heartwood Common Land brings the <br />total common land up to 13.55 acres, which already include a <br />swimming pond with trails. water garden, and water falls and <br />fountains, also a picnic shelter with play structure, and a dock and an <br />amphitheater. There is over I01.960 SF of improved recreational <br />space and the required space is 74113 SF. There is also an additional <br />acre of recreational space set aside as community garden space and a <br />1/2 acre .park below the swimming pond. This has turned out to be <br />one of the nicest developments in Orange County. The single family <br />homes to be built here will be in the current Heartwood style and be <br />priced for compatibility with current Heartwood home values. <br />We propose the extension of Heartwood Drive for ease of <br />traffic flow, sighting, and to minimize the impact on the home at <br />6402 Heartwood Dr. We have on file a preliminery letter of <br />approval from Joey Hopkins NCDOT. For aesthetic purposes, we wish <br />to preserve the quartz rock outcropping in the middle of Phase III <br />and have designed the road and set aside common land accordingly. <br />At the June 7th general meeting of the Heartwood Landowners <br />Association the Homeowners and members unaminously approved <br />Phase III to be added to the Heartwood Community. The addition of <br />further phases of development involving Dickinson land is allowed <br />for, by right, in the covenants of Heartwood Phases I & Il. For that <br />reason and for the protection of all residents, current and future, <br />Heartwood Phase III will share the same covenants as Heartwood <br />79 <br />
