62 <br />COMS REZONING REQUEST <br />Page Two <br />October 31, 1991 Based on the October 28 inspection, a <br />Certified Letter (Article No. P 409 837 683) <br />is sent to the Combs, citing them for <br />violtions of the Zoning Ordinance. <br />November 2 The Certified Mail return receipt is signed by <br />the Combs. <br />November 6 Mr. Robert H. Smith, Attorney representing <br />Combs, calls Hinkley to state that junked <br />motor vehicles have been stored on the <br />property prior to the effective date of zoning <br />for Bingham Township (September 2, 1981), <br />saying that it has been used in this manner <br />continuously. <br />Smith asks how Combs could continue to use his <br />property for the business within the <br />provisions of the Zoning Ordinance. Hinkley <br />told him that Combs could apply for a Home <br />Occupation Permit, but that the restrictions <br />would only allow 2,000 sq. ft. of floor space <br />and 1,000 sq. ft. for outside storage <br />purposes, in addition to other stipulations <br />regarding signage, screening, setbacks, etc. <br />November 11 Smith writes a letter to Hinkley reiterating <br />that the property has been in continuous use <br />for storing junked vehicles since 1979. Three <br />personal affidavits to this effect are <br />enclosed with the letter. <br />Included with the letter is an application for <br />a Home Occupation Permit. <br />Smith writes that Combs had been informed that <br />no erosion control permit would be required <br />since the newly cleared area for storage of <br />more motor vehicles was less than an acre. <br />November 22 Smith writes to Hinkley to state that to meet <br />the concerns of the County, Combs contacted a <br />Kernersville firm that buys and crushes motor <br />vehicles. He was told that the market was <br />very bad and that they were not taking cars at <br />that time. . <br />
