10 <br />repair business. At .a later time they sold ..the land to Mr. Combs for the <br />same use. He indicated that he continues to use this land to store cars from <br />his business and that Orange County needs places to store these cars. This <br />lot is not visible from the road and it serves a need in the community. <br />In response to a question from Commissioner Gordon,.Mr.. Gledhill <br />indicated that he was interested in the comments made regarding a license. <br />If a license needs to be purchased, Mr. Combs will need to take care of that. <br />However, the land use question needs to be resolved independent of whether <br />or not Mr. Combs is licensed to do business. The land use question is <br />simple. Was the property in question in existence in a commercial way in <br />1981 which is when the zoning laws went into effect in this township? If it <br />did, then there is a factual basis for rezoning the property to EC -5. That <br />factual basis ,would be that there was an error in the zoning atlas. The <br />error comes about because the intention of the County when the zoning laws <br />were put into effect was to locate all of the commercial operations that <br />existed and to classify them EC -5 or some other commercial classification. <br />Commissioner Gordon asked that this item be referred. -to the County <br />Attorney and then to the Planning Board for a recommendation, so that the <br />Planning Board would have the attorney's input. Mr. Gledhill indicated that <br />he would put his comments in writing and forward them to the Planning Board. <br />The Planning Board needs to decide if they believe that this commercial <br />operation was located at its present location and to what extent it was <br />operating in 1981. <br />Commissioner Insko asked for clarification as to what the Planning <br />Board would mean if they recommended EC -5. Would they be recommending EC -5 <br />as it existed in 1981 or as it exists currently. If it was zoned EC -5 in <br />1981, would the buildings have been permitted? Mr.. Gledhill stated that if <br />the buildings were a permitted use, they would have been approved for <br />construction. If the use was a special use, then Mr. Combs would have needed <br />a Special Use Permit. <br />Mr. Gledhill indicated that the Planning Board's recommendation for <br />EC -5 zoning will indicate whether or not the lot which is in question <br />occupied that zoning lot in 1981. <br />A motion was made by Commissioner Halkiotis, seconded by <br />Commissioner Insko, to refer this item to the Planning Board to be returned <br />to the Board of Commissioners no sooner than October 5, 1992. <br />VOTE: UNANIMOUS <br />b. The applicant is. requesting a Planned <br />
