(PIs) <br />§ 40A -11. Right of entry prior to condemnation. <br />Any condemnor without hating filed a petition or complaint, <br />depositing any sum or taking any other action provided for to this <br />Chapter. is authorized to enter upon any lands. but not structures, <br />to make surveys. borings. examinations. and appraisals as may be <br />necessary or expedient in carr ing out and performing its rights or <br />duties under this Chapter. The condemnor shall give 30 days notice <br />in writing to the owner at his last known address and the party- in <br />possession of the land of the intended entry authonzed by this sec- <br />tion. <br />Entry under this section sha'I not be deemed a trespass or taking <br />within the meaning of this Chapter. however, the condemnor shall <br />make reimbursement for any damage resulting from such activities. <br />and the owner is entitled to bring an action to recover for the dam. <br />age. If the owner recovers damages of twenty -five ppeercent (251/c) over <br />the amount of Bred by the condemnor for reimburser`~ent for its <br />activities the court, in its discretion, may award reasonable attorney <br />fees to the owner.
