KEMORANDUM <br />To: Landfill Owners' Group <br />From: Bruce A. Heflin, Chapel Hill Public Works Director <br />Subject: Report on Landfill Search Process <br />Date: June 25, 1992 <br />The attached report on the search for a site for a new landfill <br />attempts to respond to questions recently raised by the Carrboro <br />Board of Aldermen, Chapel Hill Town Council, and Orange County <br />Board of Commissioners. The attached resolution would refer the <br />report in final form to the governing bodies of the three <br />governments for their review. <br />Background <br />During recent meetings of the Carrboro Board of Aldermen, Chapel <br />Hill Town Council and Orange County Commissioners, the three <br />governing bodies were asked to grant to the Town of Chapel Hill the <br />authority to exercise the right of eminent domain to acquire access <br />to sites which the Landfill Search Committee recommended for <br />testing. During their deliberations on the request, the three <br />boards raised questions about the search process. The County <br />commissioners requested that a full report be made to the Board <br />before they acted upon the request for enforced access to the <br />sites. The Carrboro Board deferred action pending receipt of <br />additional information. The Chapel Hill Council approved the <br />proposed agreement,'but also asked for some additional information <br />concerning the site search. <br />At the May 25 meeting of the Landfill Owners' Group, the Owners' <br />Group agreed to make a formal report to the three boards, <br />responding to lists of questions posed by the board members. The <br />staff was asked to work with the landfill site selection <br />consultants to prepare answers to the questions. <br />Discussion <br />The attached report responds to the questions posed by the three <br />governing bodies. The questions are listed by point of origin, as <br />provided by the Managers. Answers were prepared by staff and the <br />consultants. Where there was duplication of questions, the first <br />appropriate answer is referenced. <br />It now appears that should the Owners' Group approve the report and <br />send it to the governing bodies, it could be presented as follows: <br />
