rJ <br />limited to the following: employment, upgrading, <br />demotions, or transfers; recruitment or recruitment <br />advertising; layoffs or terminations; rates of pay <br />or other forms of compensation; selection for <br />training, including apprenticeship; and <br />participation in recreational and educational <br />activities. The Agency certifies that it presently <br />has in effect such an affirmative action program <br />which specifies goals, and target dates to assure <br />the implementation of such plan. The Agency agrees <br />to post in a conspicuous place available to <br />employees and applicants for employment, notices <br />setting forth the provisions of this non- <br />discrimination clause. The Agency shall in all <br />solicitations or advertisements for subcontractors <br />or employees placed by or on behalf of the Agency, <br />state that the Agency is an "Equal Opportunity <br />Employer." The Agency shall make no distinction <br />because of race, color, handicap, religion, sex, or <br />national origin in providing to eligible individuals <br />any services or other benefits under projects <br />financed in whole or in part with Older Americans <br />Act funds. (This provision excludes age since the <br />Older Americans Act serves only older persons by <br />design and by law.) The Agency shall keep such <br />records and submit such reports concerning <br />characteristics of applicants for employment and <br />employees as the COG and the Concerned Funding <br />Agency may require. The Agency agrees to comply <br />with such guidelines as the COG or the Concerned <br />Funding Agency may issue to implement the <br />requirements of this paragraph. <br />The Agency will cause the foregoing provisions to be <br />inserted in all subcontracts for any work covered by <br />this Contract so that such provisions will be <br />binding upon each subcontractor with the <br />understanding that the foregoing provisions shall <br />not apply to subcontracts for less than $10,000.00. <br />(b) The Agency shall keep such records and submit such <br />reports concerning the racial and ethnic origin of <br />applicants for employment and employees as COG or <br />the Concerned Funding Agency may require. <br />(c) The Agency agrees to comply with such rules, <br />regulations or guidelines as COG or the Concerned <br />Funding Agency may require. <br />24. Changes. COG may require changes in the work and <br />services which the Agency is to perform hereunder. Such <br />changes, including any increase or decrease in the amount <br />of the Agency's compensation which are mutually agreed <br />upon by and between COG and the Agency, shall be <br />incorporated in written amendments to this contract. <br />
