3 <br />d) Reprogramming of Funds. It is understood and <br />agreed that, in the event that the amount of <br />funds received from the Concerned Funding <br />Agency is reduced, COG may, in turn, decrease <br />the total compensation and reimbursement to be <br />paid hereunder and require corresponding <br />changes in the Schedule I. <br />It is further understood and agreed that, in <br />the event at the end of each quarter, the <br />Agency's rate of progress on this Contract is <br />leading to underspending at the end of the <br />Contract period, due to inability to provide <br />services at planned levels, COG may decrease <br />the total compensation and reimbursement to be <br />paid hereunder in order to allocate funds to <br />other contracts and services. <br />e) Change of Unit Cost Reimbursement Rates. COG <br />may renegotiate the reimbursement rates as set <br />forth in Schedule I. The parties agree that <br />COG will consider increasing the reimbursement <br />rate only under two circumstances: <br />(a) Upon a showing by Agency that actual costs <br />have increased due to factors beyond <br />Agency's control; or <br />(b) Upon a showing by Agency that actual costs <br />have increased due to sudden increase in <br />client load (i.e. due to a disaster <br />event) . <br />The parties further agree that COG shall have <br />the right to decrease the reimbursement rate <br />under any circumstances which show the actual <br />costs are ]less than projected; including, but <br />not limited to, circumstances in which: <br />(c) Overall costs of providing service are <br />shown to be less than forecast in the <br />Agency's original bid for service; or <br />(d) The Agency fails to document the required <br />local match such that the COG <br />reimbursement rate exceeds the percent of <br />total service costs as indicated in <br />Schedule I. <br />In the event the reimbursement rates are <br />decreased, COG may, at its option, increase the <br />total number of units of service to be <br />delivered. <br />
