If Lessee proceeds <br />without Lessor's consent, however, Lessee agrees, at Lessor's <br />election, to restore the Premises to the condition which existed <br />immediately prior to the time that such alterations, additions and <br />improvements were made. <br />(d) Contractor and Materialman's Liens and Claims. Lessee <br />agrees that any alteration or improvement, whether major or minor, <br />shall be made at Lessee's sole risk and expense. Lessee covenants <br />not to permit any contractor's or materialman's lien to attach to <br />the Premises, and agrees to indemnify and hold Lessor harmless from <br />any damages incurred by reason of any claim or lien by an unpaid <br />contractor or materialman, and further agrees to reimburse Lessor <br />for any amounts paid by Lessor to discharge any such contractor's <br />or materialman's lien; provided, however, Lessee shall have the <br />right to contest in good faith by legal proceedings or otherwise <br />any lien asserted against the Premises by any contractor or <br />materialman, and Lessor shall not interfere with and shall assist <br />Lessee where reasonably necessary, but at no expense to Lessor, in <br />such protest. In the event Lessee shall determine to contest such <br />lien, Lessee shall post with Lessor a good and sufficient surety <br />bond in an amount not less than one hundred twenty -five percent <br />(125 %) of the lien so contested conditioned upon the Lessee paying <br />all the cost of satisfying the lien plus interest and costs which <br />may be determined to be due upon the claim. <br />4.02 PUBLIC LIABILITY.
