(4) Defaulted Rents: Collection costs. In the event <br />Lessee fails to pay rents covenanted herein when due and collection <br />proceedings are instituted by Lessor, Lessee shall become obligated <br />for, and shall pay, all costs of collection, including an <br />attorney's fee of fifteen percent (15 %) of the past due rents if <br />such collection is effectuated by an attorney. The parties agree <br />that the rental covenants set forth are evidence of indebtedness <br />for the purpose of this subsection. <br />(b) Taxes. <br />(1) Pro -Rata Share of Ad Valorem Taxes. As additional <br />rent hereunder, Lessee shall remit to Lessor on or before December <br />15 of each calendar year in which this lease is in effect its <br />prorata share of real property ad valorem and special district <br />taxes assessed upon One West Franklin Building. Lessee's pro rata <br />share shall be computed by multiplying the total real property ad <br />valorem and special district taxes assessed upon One West Franklin <br />Building by the number of days during the calendar year this lease <br />is in effect by 3.67 %. <br />Lessee's failure to make a prompt remittance of its pro rata <br />share of such taxes on or before December 15 shall constitute a <br />material breach of this Agreement and an event of default <br />hereunder. <br />(2) Other Taxes. Lessee shall pay all personal property <br />taxes levied or assessed against the Premises and its contents. <br />Lessee shall also pay all personal property taxes levied or <br />assessed against any personal property now or hereafter owned by <br />-8- <br />
