5 <br />Carrboro Board of Aidoraon <br />1. 1he landowners lhould be-leimburnd for damage e <br />the process of obtaining these surveys and examinations. <br />It is our intention to minimize damage to the subject properties <br />which might. result from the preliminary geotechnical <br />investigations. Our staff, including the Town of Chapel Hill's <br />Urban Forester and /or the Carrboro Landscape Supervisor, will <br />accompany the consulting team when they survey the properties to <br />determine the drilling sites and the best routes into and out of <br />the test areas. We will attempt to minimize conflicts with <br />significant trees, and take steps to protect as much of the <br />property, including. vegetation, as practicable. In the event that <br />damage does occur, we will work with the affected property owners <br />to resolve claims, including monetary reimbursement as appropriate <br />in accordance with applicable law. <br />2. Additionally, the property owner <br />or his or her representative will be invited to accompany the <br />consulting team as they survey the properties to confirm the <br />location of the test areas. The Landfill Owners Group staff and <br />the consultant will inform the landowners of all investigative <br />activities. <br />3. That a priority list be RreRared so that all four sites are not <br />entered and damaged when on-ly one will be chosen. <br />One reason for testing more than one site at a time is that having <br />engineering and geohydrological information on more than one site <br />will allow for relative comparisons between the sites. It is <br />likely that all four sites will meet minimal standards for siting <br />a landfill. Looking at the four together would provide the <br />Landfill Search Committee the opportunity to evaluate the technical <br />merits of the sites and weigh those factors against other factors <br />such as socio- economic values. The technical information is a <br />critical component of the Committee's selection process, but not <br />the only factor in their decisions. <br />4. On what basis can Chapel Hill have authority of eminent domain <br />outside its jurisdictional lines? <br />Authority for the Town of Chapel Hill to exercise eminent domain <br />outside its jurisdictional lines is found in General Statutes 160A- <br />312 and 40A -3 and 40A -11 (see copy provided as Attachment 6). The <br />law provides that units of local government may exercise the right <br />of eminent domain to acquire property to provide for certain <br />"public enterprises," among which are landfills.
